Whoever had the clearest shot with the least risk for collateral damage, as decided by the swat sniper(s) and the team leader. I saw the video, looked like a clean shoot to me. He was using the Hostage as a shield, and was attempting to leave. What cops call "escalating" . The use of force policy in most departments calls for an attempt to de-escalate the situation when possible. Sometimes you get one who has no intention to calm down. In those cases deadly force is authorized to prevent further harm to the hostage and the public at large. While I have seen some questionable uses of force by cops these days this one is pretty straightfoward.

Cuffing the perp, regardless of their condition(alive,dead, conscious, not conscious, etc) is standard procedure. It's part of securing the scene.
