It's outrageous to think that 12% of the population (i.e millions of people) could dare to think their wishes and needs outweigh the arbitrary rulings of 9 individuals.

If you look at the words of our founders, they very much saw the people as a 4th branch of government in a whole range of situations.

A jury could simply ignore the law and the constitution in the specific case they were judging. Actually its still that way today but the supreme court ruled to hide it in 1895 with a ruling that jurors need not be informed of their rights.
