That does sound strange. If the cops are called to investigate a burglary in progress, the last thing they will do is stop to get a search warrant (which would not be required in that case). And in the middle of the night, no less.

This was what the cops told the Grand Jury? He raised his gun at the cops???

Why in tarnation would a law abiding citizen do that?

Not exactly. It was a grand jury, not a trial jury. Who knows what evidence the DA didn’t present?

Years ago, a man, not in uniform, pointed a gun at me and ordered me to freeze. I didn’t. Then there were cops in uniform all over me. He demanded to know why I didn’t freeze. I screamed at him, “You weren’t in uniform. You never identified yourself. I thought I was being mugged.”

My guess is, they never identified themselves. Their story may be a lie. But only they know and they’ll probably convince themselves that they did.

Being a cop is a tough and sometimes scary job. It does require the ability to read numbers and addresses. I'd like to know if the cop messed up the address or the dispatcher did but that is just curiosity. This family needs to get the best and most ruthless lawyer they can find and rip this department to shreds. The LEO’s had no legal reason to be there this is all on them.

I also have to question the grand jury on this one. Someone made a mistake and that was pure negligence and the LEO did in fact kill a totally innocent man, that is homicide. So by definition a negligent homicide did occur. The castle doctrine, SYG, self defense, and the fourth amendment all fall on the side of the guy who was shot.

I believe that this was an accident, BUT, those responsible for this accident must be held legally and criminally responsible. Responding LEO's in the future must know that a mistake of this kind will have very harsh and real consequences.

The IA investigation in this incident should be open to the public. The DA should be required to release all information obtained in interviews and during investigation. The public should be made fully aware of what happened before and after this homicide and why charges were not brought against the LEO who pulled the trigger. There should be an unobscured view of exactly who made what mistakes and how it all went down.

All of these things will come out in a civil case anyway. We the people pay for all of this and the information should be public.

He raised his gun at the cops??? Why in tarnation would a law abiding citizen do that?

Can't say for sure regarding the deceased, but if I wasn't convinced the people breaking into my house for no reason were police, I might raise my gun.

I wonder if the family is going to sue and if a legal fund can be set up to help them pursue justice? Then, if they win, the healing can begin, not as the Chief of Police stated after the decision not to prosecute the cops.

Didn’t the cops in Fort Worth shoot another senior citizen in Fort Worth last year (in his own driveway)? I thought there were some threads here on FR about the earlier shooting.

My guess is it’s more crappy reporting.

They probably had a warrant to look for goods that were at a
place(wrong place in this case) related to coming from a burglary.

The family will sue, taxpayers will pay, cops will get a paid vacation.

Sorry for your loss family.

However, any sane person knows you don’t go outside with a gun unless you know what you’re doing and who is there.

The cop’s excessive shooting should have been noted.
Also they’re picking the wrong house. That can be avoided....Too eager.

Both parties are to blame.

If a person busts in my house with a gun and I’ve done nothing wrong why would I take their word at face value that 1. he is really a cop, and 2. even if he is a cop, that he has good intentions?
There are many reports of gangs that dress in SWAT gear that says FBI on their jackets.
If that buys them a few seconds of reluctance on the part of the armed homeowner that’s all they need.
We can thank the never ending war on drugs for all this nonsense.
I guess innocent Americans getting killed in their homes by their own government is just the price we pay to live in such a loving nanny state. Sheesh.
