Colorado legislators propose repeal of anti-gun laws as local district ends ban on open-carry

With two anti-gun Colorado state legislators recently voted out of office and a third retiring facing another recall election it’s clear that gun control isn’t the non-issue so many in office assumed it would be.

Now several legislators are working to repeal the laws passed early last year in Colorado, with a new package of house bills that would roll back the recent changes.

Although Colorado citizens recently voted to recall two proponents of the gun control package, including then state senate president John Morse and senator Angela Giron, the Democratic Party still holds a majority by one vote. A third recall attempt against sen. Evie Hudak resulted in Hudak resigning, allowing the majority to select their own replacement candidate.

But before they can be voted on they must first pass the State, Veterans, and Military Affairs Committee, which is known informally as the “kill committee.” The committee votes on whether or not proposed legislation hits the state house or senate floor.

The committee has been used by both parties to knock back legislation that is unpopular with the majority, explains the Colorado Second Amendment Association.

“The bills listed below include several that would outlaw parts or all of the 2013 gun laws forced upon us by agenda-based, out-of-state interests. The passage of those laws was so onerous that it resulted in Colorado’s first recalls of sitting state legislators by a citizenry insulted and ignored by its elected government. These may very well be some of the most important bills that we are going to see pass through our Legislature this year. Yet the bills were sent to their respective ‘kill committee,’ in what could easily be viewed as another sign of contempt for the voting public of Colorado.”

Six bills have been proposed, including house bills HB 14-1063 (.pdf), “Deadly Force Against Intruders At Businesses” and HB 14-1151 (.pdf) “Repeal Ammunition Magazine Prohibition” and senate bills SB 14-038 (.pdf) “Governor Cannot Restrict Firearms During Emergency,” SB 14-090 (.pdf) “No Background Check For Step-relations,” SB 14-094 (.pdf) “Background Checks And Fees For Gun Transfers” (to repeal mandatory background checks for face-to-face transfers) and SB 14-100 (.pdf) “Repeal Large-capacity Ammunition Magazine Ban.”

Two of these bills, HB 14-1062 and SB 14-090 seek expand on gun rights, even if the other bills do not go to the floor or do not pass.

Currently the Colorado House State, Veterans, and Military Affairs Committee has a democratic majority of seven to four, and the Senate State, Veterans, and Military Affairs Committee has a democratic majority of three to two.

Still, with the recent recall elections and polls showing increased calls to repeal existing gun control laws, it may not be business as usual for the committee. And the magazine capacity limit, by far the least popular of all the recently-passed gun control bills, is facing repeal in both the state house and state senate.

The magazine ban and the mandatory background check bills are still headed toward the courts, as well.

Originally backed by an overwhelming majority of the state’s sheriffs, a judge recently ruled that the law enforcement agents could not sue the state as civil servants. The ruling did allow them to hang on as plaintiffs, joining the gun rights and civil rights organizations and manufacturers also backing the suit, including Magpul, who is moving manufacturing of all their products to Texas and Wyoming in protest of the new laws.

Gun rights supporters have rallied across the state following the passage of the gun control package. Recently the town council of Castle Rock, Colo. repealed a decade-old ban on the practice of open-carry, by a vote of four to three.

“My point-of-view is to restore the constitutional rights to the people of Castle Rock,” said Mayor Paul Donahue to the Coloradoan. Donahue supported the repeal.

“Our freedoms are constantly being stripped away and the decision to repeal the open carry ban sets Colorado on a course of restoring freedom, rather than limiting it. Castle Rock Second Amendment supporters stood up for their rights and in doing so have invigorated gun rights supporters across the country,” said political director Joe Neville of the Rocky Mountain Gun Owners foundation.

Hey Bud. Good to see you.

Two successful recalls were kind of exciting, but the fact that the laws were still on the books tempered that. If those laws go away, now that would be the real victory.

"I’m actually thinking quite seriously about moving to Colorado within the next few years, mostly for the elk hunting possibilities and the close proximity to other great hunting opprtunities."

Regulations Brochures (see "big game")

Be ready to jump through quite a few bureaucratic hoops, though. There are the lottery, assignment to some zone away from home, huge costs, etc.

We need to treat these socialists just like a tree, grind them down to until the stump is below the ground.

Try elk hunting when you live in Ohio. can you say “next to impossible”? I’m liking the four corners region personally as this puts one in close to proximity to all kinds of good hunting and long range shooting opportunities. There’s basically no place around here to stretch out a high powered rifle. Hunting of any kind in Ohio is kind of a joke. I’ll find my west eventually.

Maybe it’s Colorado, not Texas or Georgia or Alabama or Kansas or Tennessee or Virginia, where the true hope for the seeds of restoration lie.

It seems like I heard that somewhere once before.....

That sounds delightful in theory - but how do you explain the fact that someone like Wendy Davis could ever get the impression for a microsecond that she could win a Governor’s seat? I mean, hopefully what you are saying is true and Ms Davis is just completely mentally ill.

The democrats always run somebody. They never skip an election.

Doesn't mean that they have a chance in hell of winning.

I think Windy (spelling on purpose) is thinking about a national stage, and the $$s that will be coming to her campaign.

Even losers in a political race rake in the $$s.

You need to go on meds or something. I'm going to start calling you Debbi Downer. As long as life exists, hope exists.

Don't give up until AFTER they have kilt you.

Also consider here in south-eastern WA state. Very different from west of the Cascades culturally, climate-wise, and about every other sense. High power range, elk and all that.

Well considering that your posts often suggest that we will all be forced to become complete Amish soon, I gotta say, following yours posts and posts of similar Freepers, if anything, often aid in increasing one’s suicidal depression. Especially considering that many of us, on top of everything we are stuck fighting with, are simply not in a position where they could ever be able to turn Amish on short notice of any kind. About 90 % of Americans a re in a situation where that is just not possible.

JRandomFreeper is not rare at all. Many here in Texas are capable of being totally self sufficient. Not that I think it makes sense under current conditions. But none of us can predict the future.

Should we have a global financial collapse, Texas could go it on it’s own. And many of the citizens are capable of picking up the pieces and surviving.

I assure you my ancestors understood this well. There are still oral traditions not in history books that are remembered from those times.

Every year many in the South & West eat dried blackeyed peas and greens for good luck. And to never forget those times when that was all that was left for our ancestors to eat.

If these bills get killed in committee, there should be recall petitions filed against every single Democratic member of the given chamber’s committee simultaneously. Show them that voting to restrict Constitutional rights is not actually in their best interests politically.

The Four Corners area might be the best choice in Colorado—maybe fewer busybody NIMBYs, fewer regulations, and less ice and snow than on the central Range.
