Ruth Bader Ginsburg is one of the more important liberal litigators and jurists of her generation. She has been trailblazer on the issue of women's legal rights and a powerful voice for progressive causes as a justice on the highest US court in the land.
And she must retire. Right now. While we're at it, Stephen Breyer should retire too.
This call has nothing to do with either justice's job performance. Ginsburg's commanding dissent in last year's 5-4 decision to overturn a key provision of the Voting Rights Act is compelling evidence that she remains a vital member of the court.
But no longer is the decision of when to retire about them; rather it's about what comes after they leave the court. If Ginsburg and Breyer wait to retire, it will only serve to maximize the possibility that a Republican president will choose their successor and in the process undo much of what they've worked for their entire careers.
To be sure, I'm not the first person to make this argument and Ginsburg has publicly pushed back on talk of her leaving. What's changed in recent weeks, however, are new poll numbers that suggest Democrats are at very real risk of losing their majority in the Senate. While such an outcome next fall would be demoralizing for Democrats, it wouldn't have much of a policy impact. No matter who controls the Senate, House Republicans are hardly leaping at the opportunity to work with President Obama. It would, however, make it much harder for Democrats to fill the judiciary with progressive judges.
Even worse, it would increase the possibility that President Ted Cruz, Rand Paul or Paul Ryan might appoint Ginsburg and Breyer's replacements, which is a risk that, as liberals, they simply shouldn't be taking.

Gee I thought the libs always screamed at us when Republican presidents were about to appoint someone to SCOTUS that the court isn’t political.
They’re so worried about having their liberal damage undone.

Drudge has linked a few articles from friendly sources lately questioning if Hillary will run and if so, does she have the fire in her to do so. Charlie Cook has one today which is linked on Drudge and he is worried that Hillary will be older than Reagan when she hits the trail and two the big elephant in the room which no body in the Drive By media like the ass kissers on MSNBC talk about IS HER OWN HEALTH noting her falls before she left the Dept of State in January 2013.
Of course the other big elephant in the room is the state of the Economy and Obamacare. There are tea leaves in the latest data that suggest we might be headed for recession soon. If it hits in 2015 with it's full force, the Democrats will be in deep poop. She (or whomever the Rats choose) will have to defend not only a faltering economy like McCain did in 2008,but also the on going clusterfark which is Obamacare. Hence, the Libs like this author must be worried that no matter who runs on the Rat ticket, they will lose. They probably think Ginsberg who is bad health will not leave in time for a replacement for sure and are worried that Bayer will have to leave either in the first term of a GOP President in 2016. Or possibly a second if he or she is reelected in 2020.
This on the condition we still have a Republic in 2016.
Back in the day, they would have been hauled in front of a Congressional committee and forced to admit their communist party affiliation. And then be given the old Rosenberg treatment depending on the severity of their treasons.

I have no agreements with the judgements and political leanings of Ginsburg and Breyer. But I am shocked by liberal suggestions that they getout of the way so Obama can appoint their replacements now. What’s wrong, are tHey upset Ginsburg at age . 81 Is still alive and with us??? . What the heck????
Why should she? Senate GOPers will apporve any turd 0bama shoves down their throats regardless of the mid-term results.
You’re right...any “black” appointee (Holder, etc) could play the race card and skate through the nomination process no matter how many Republicans. Obama has plenty of time.
Ginburg has already said she isn’t going anywhere. I don’t think she would know what to do with herself if she couldn’t dress up in her tent and doilie and lord over the masses.

There should be a mandatory retirement age for every govt. employee, especially the supreme court, all judges in general, the U.S. Senate and the House of Reps........
So far, fortunately, Ginsburg’s ego won’t let her accomodate Jarrett.
So Ronald Reagan shouldn't have been allowed to run for a second term?
The Constitution addresses and limits the presidency..........
...and the Supreme Court and the Congress.
