Classification of federal crimes by sentence is under 18 USC 3559.
You will note that a first conviction of 1325 is a class B misdemeanor and the second is a Class E felony.

I worked and grew up next to the Mexican border. You cannot imagine just how serious it is to cross illegally - it’s a war zone east of Nogales and now even west of it.
No one who crosses illegally is unaware of the seriousness. There are armed men everywhere, warning signs, lights at night (you should see the Rio Grande at El Paso at night - klieg lights for 20 miles), fences, walls, guns, bandits and drug smugglers.
It is a brazen and deliberate act to cross into the US illegally. No one can plead ignorance.
Many of these fall into “After an alien has been legally “removed” from the United States, federal criminal law makes it a felony for that alien to reenter (or be found in) the country without approval of the government. “

Unfortunately, like many of the major debates in Washington, immigration has become a stalemate-where both sides are imprisoned by their own rhetoric or attachment to sacred cows that prevent the possibility of a balanced solution.
Immigration Reform will not occur until Conservative Republicans, like myself, become part of the solution. I am here today to begin that conversation.
Let's start that conversation by acknowledging we aren't going to deport 12 million illegal immigrants.
