Republicans: Obama violating Constitution, but little can be done about it
foxnews.com ^ | February 16, 2014

Washington Republicans on Sunday restated their argument that President Obama has violated the Constitution by using executive orders to alter the Affordable Care Act, but acknowledged they likely have no recourse or ability to stop another incident.

Sen. Mike Lee, R-Utah, told “Fox News Sunday” that congressional Republicans think the president abused the government’s separation of powers by using the executive orders to sidestep Congress and delay the law’s employer mandate.

However, he said critics would have a tough time winning in court because Congress lacks the so-called “legal standing” to present the case and they would have a “tough time” finding somebody hurt enough by the delays to be a good plaintiff.

“The president knows this is wrong,” said Lee, among the most outspoken ObamaCare critics. “What gives him the ability to rewrite the law?”

Patients dying from cancer get refused treatment.

They should have ‘standing’.

I doubt even one Freeper here can name one thing the GOP has promised
to do if they take the senate and maintain the House, because I have not
heard or read what they plan to do with the power they may be given.

every couple of weeks some repub comes out and claims Obama is violating the law, but they don’t have the balls to do anything.

At breakfast, I grabbed the front section of the LA Crimes at the cafe. They had a puff piece on Holder. This is the guy that fired the investigator who had the mayor of Sacramento, Kevin Johnson, dead to rights. But Johnson was an Obama supporter and one of Holder’s people. Then he applied racial differences to prosecutions and then fast and furious and on and on. Has Holder been removed, of course not.

And some say he’s on his way to the USSC. How will the republicans stop that? They won’t.

If the repubs had leaders in congress. they would mount a national campaign showing what will happen with a senate GOP majority.

“...critics would have a tough time winning in court because Congress lacks the so-called “legal standing” to present the case and they would have a “tough time” finding somebody hurt enough by the delays to be a good plaintiff.”

Pathetic! Stupid!

This notion of standing has to have a limit, surely. If the American taxpayers don’t have standing to challenge fedgov, we are lost. It is, after all, the taxpayers who fund the government, ultimately; whether operating funds or debt service.

Get his many violations on record by impeaching him. And get his co-conspirators in treason on record too, when they (the senate democrats) refuse to remove him for high crimes and treason.

In the case of usurpation of powers not granted, Congress IS the court.

Why doesn’t Congress itself have “legal standing” if the separation of powers is being violated?

... and it's a law passed by Congress that is being illegally changed!!

This has nothing -- absolutely nothing -- to do with "standing". It's that no one in a position of authority -- no judge and certainly no politician -- wants to go down in history as the one responsible for impeaching or removing the first "black" president (even though, of course, the petty tyrant is only fractionally "black" and, more importantly, what is being attacked here by the petty tyrant is the U.S. Constitution itself!)

Maybe if the MAJORITY (i.e., repubs) in the House would stop funding these illegal moves (and others) they could “do something.” They won’t, however, because they are weak, feckless, spineless, leaderless, ba**less, gelded, whiny, insipid and timid. Whatever happened to the “power of the purse”?

Why not try impeachment? What have they got to lose? Oh, he’s black.

I am very discouraged. Can you imagine the damage Obama will do in three more years?

Interesting that Mr. Lee is so resigned over this.

You can only try.

Write up articles of impeachment. Give it a try. What are they afraid of?

Riots by the Angry Black supporters of the Thug?

Who cares?

Other men fight and die in places like Afghanistan and Iraq over far less, sent there by “men” like Mr. Lee...who I thought had something going.

Yeah ... you’d think the timid members of the GOP caucus would be able to deal with something they undoubtedly know a lot about ... Purses!

No, it’s simpler than that. Just cut off the money. God loves Lee and Cruz and ao do I, but “Republicans” COULD STOP THIS if they had the balls to do it!

And , I mean ALL OF IT!!!

Call the bastards bluff and “shut er down”. Approve only payments for which there is money in the bank! That’s about 80%. So be it!!

So, pubbies are just as much to blame “as a party” as the democrats. Period!

I think what Senator Lee is saying is that to challenge Obama in court, there has to be someone who has standing on that issue. That would be a specific situation in which someone's rights were violated by Obama's actions.

He's not saying it shouldn't be done if such a viable legal situation happens.

So does this mean that ‘Washington Republicans” think we have a faulty Constitution? Maybe they should join The Bozo in overturning it.

We can’t impeach 0bama until we take the Senate back. Currently, 0bama could throw live babies into a wood chipper on prime time TV and the Senate would still do nothing.

“... and they would have a “tough time” finding somebody hurt enough by the delays to be a good plaintiff.”

It would be easy to find a plaintiff.

Find an employer with 110 employees forced to provide insurance, to sue over his disadvantage competing with an employer with 95 employees that doesn’t have to provide insurance.

Or...

Find an employee in a 90 employee company, in a state with no Medicaid expansion, that doesn’t get insurance, and makes too much for Medicaid.

Both cases should be easy to find.
