Justina Pelletier’s Mother Collapses After Court Orders Daughter to Non-Medical Foster Care Facility

BOSTON,—The family of Justina Pelletier was emotionally distraught after a judge sentenced their sick daughter to the foster care system without access to her previous medical care. Justina is at the center of a legal battle between the Pelletier family and Boston Children’s Hospital over custody and proper medical treatment.

Attorney Mat Staver of Liberty Counsel filed a motion for pro hac vice to represent the Pelletiers, but the judge took the rare move of allowing the Massachusetts Department of Children and Families (DCF) to respond to the motion, effectively denying the specialist attorney from arguing in the hearing.

To keep the case under wraps, the judge ordered media to leave the courtroom and took the unconscionable step of transferring Justina’s custody to the foster care system, where she will not have access to treatment for her mitochondrial disease. Her family is deeply concerned for her life and safety.

Boston Children’s Hospital performed a controversial medical-legal maneuver colloquially called a “parent-ectomy” last year, seizing custody of Justina after disagreeing with her parents and physicians at Tufts Medical Center about her diagnosis and treatment. Since losing custody, Justina’s condition has steeply deteriorated.

After receiving the judge’s shocking decision today, the Pelletier family was heartbroken and distraught at Justina’s plight. Justina’s mom, Linda fainted in the courthouse hallway and had to be taken by ambulance for care.

“I was nearby when Linda collapsed, and it was heartbreaking,” relayed Keith Mason, Personhood USA President. “No parent should suffer as the Pelletiers are suffering. Knowing that their daughter will be cruelly and intentionally transferred to a facility that is unable to care for her medical needs is devastating.”

In so doing, you would turn yourself into the very thing you fight.

Really? Would you go personally, and with forethought and premeditation and hurt or kill innocent children to try and get at this Judge?

The Judge is deserving of very serious consequences, as are the others who are perpetrating this evil. I hope they receive it in full measure...and if the girl dies this long, suffering, lingering death because of this travesty, then they should be on trial for their lives too.

But going after their families...their children...is not the answer. It would literally turn anyone who went down that path into the very thing they are fighting and all justice, morality, and, IMHO, the help and assitance of God in Heavenwould go out the window with it. And understandably so.

Nope, I would not personally go after them, but I could understand why someone would and, to be honest, my heart wouldn’t bleed too much. Don’t you think this judges “values” have been taught to the children to perpetrate?

She got the flu and it was suggested she go to Children’s Hospital for treatment which she did.

That was because the doctor she had been seeing at Tufts had moved to BCH. But when she turned up at BCH, the quacks who admitted her refused to allow her to see her former Tufts doctor.

Not unusual that doctors disagree on a diagnosis. So why wasn’t a third doctor or third team of doctors brought in to review the records and examine the child?

Because that would question the authority of the BCH quacks and Deval Patrick's DCF.

If that were it, the girl would be getting better, not worse, since she is no longer with her mother.

She has been moved to a foster home. I would say that is evidence that she is not getting worse.

It’s obviously not Munchausen by proxy. The daughter has been away from the parents for some time now. If her symptoms were inflicted by her mother she would be cured by now. Looking at her pictures she appears markedly worse.

A feature of Munchausen by proxy is that the children learn to pick up signals from the Munchausen parent and act more sick than they really are.

We cannot forget that she has had some pretty drastic surgery; she will never be "cured" regardless of what the true situation here is.

The reason Justina was sent to Boston Children’s Hospital was because the gastroenterologist that was previously at Tuff’s was now at Boston. They were never able to see him - when they got to Boston, some other doctor (7 months out of medical school) interceded and made the alternate diagnosis within 12 hours.

Judging from my own experience working in a hospital, diagnoses are not typically made by a single physician acting alone--especially in a case where an intern is the primary physician. If an alternate diagnosis was made within 12 hours, that suggests that some behind-the-scenes discussions occurred. Of course, what actually went on to diagnose the girl is completely unknown; we only have one side of the story.

Yes we do. As reported by Megtn Kelly, she is now in a wheelchair where before she was ice skating.

What independent evidence do we have of that? We do *not* have any evidence other than the family's story, and there certainly is not enough public evidence for anyone to make any conclusions about this case. Whether this is a genuine case of injustice, or an appropriate removal of a child from an abusive situation (Munchausen by proxy) cannot be determined by the public story.

Correct - the other side of the story has been gagged - for “confidential” reasons ( which may be typical? in such cases )

The info in post 26 was a very short summary - from videos and articles. Apparently the Boston Globe has been covering this story.

His wife and oldest daughter were able to briefly see Justina last Friday, Lou told Glenn Beck Tuesday, and “what they saw appalled them.”

“She has a port into her colon. There were severe red lines, no doubt poisoned sepsis creeping into the system,” he said slowly. “The DCF people were laughing at it. So we had to raise a red flag. We talked to one of the top surgeons … who goes, ‘that could be deadly! What are they doing? That needs to be checked immediately!’ … We had to beg to get a doctor to come in and look at it.”

There’s enough evidence for me to recognize that the other side needs to explain themselves but instead they hide behind a gag order to the detriment of justice and quite likely the health of the child.

What sort of independent evidence do you believe is obtainable when there is a gag order and what we do know comes from the defiance of that by the father after one year of not having custody of his child?

It is a feature of people with Munchausen syndrome (with or without the "by proxy" part) that they will shop around until they find a doctor who will make a diagnosis. I seem to recall reading that this girl was never formally tested for mitochondrial disease, but was diagnosed based on the fact that her sister was already diagnosed. (Which raises the question of whether the sister really has the disease or is a victim of Munchausen by proxy.) I do not blame the doctor if it is the case that this girl was healthy and he made this diagnosis--people with Munchausen can be quite convincing, and the child in these cases learns how to act sick at cues from the parent.

Please keep in mind that I am not saying that I definitely think Munchausen by proxy is going on here. I am saying that there is not enough evidence to rule it out.

I do not know about any "gag order", but I am quite familiar with HIPAA law, which prevents medical providers from discussing details of patient diagnoses and care with third parties. The penalties for violating HIPAA are quite strict, and include prison and hefty fines. If the family has not specifically given the hospital or physicians involved permission to divulge medical details, they absolutely cannot do so. Hence, we can only hear one side, which may not be completely factual.
