The Lois Lerner Defense

Mark Steyn

....The IRS is corrupt, and should be abolished, and replaced by an agency with far fewer powers. Instead, Republicans dither ineffectually. In Congress last week, IRS fall girl Lois Lerner took the Fifth again. That's her right, of course, and very prudent given the malicious and selective prosecutions of a corrupt Justice Department. But in my column below I quote Walter Williams observing that every single US tax-filer signs away his Fifth Amendment rights every April 15th. My piece was written last May, when the scandal broke. It ended with some advice that self-respecting American citizens ought to try the Lois Lerner Defense when the IRS comes a-callin'. Ten months on, it's more pertinent than ever: ....

So what’s the story with Steyn and NRO? If they fired him I’m through with them, if they drove him to quit I might be.

he BEST way to curb the IRS excesses is to repeal every amendment to the Constitution that was passed in the 20th Century.
One or maybe two could then be revisited. Then we could look at the consequences of the amendment and know if it should be passed again.

The last I read, Mark is still writing columns for NR magazine, but is not doing pieces for NRO. I think that was early February.

Huh. That’s because of the fight with that little schmmuck they’ve got working there. That website is falling apart. they didn’t even have the results of that FL special election on the Corner, long after it was posted here.

Well, I think this steyn thing sounds like a big ruse to get people to take the magazine.

He is credited for the “Happy Warrior” section in the March 10th issue of the magazine.

It certainly is. I missed it when it was first published last May. Glad I stumbled across it today.

I think you may be right. I used to subscribe to the magazine. After Lowry took over and then Buckley died, I finally gave up on it. A real shame. NR was something I used to look forward to finding in my mailbox.

The 27th should be ok, having been written in the 18th century. The 25th may be ok. BUT WE REALLY NEED TO KEEP THE 22ND. Do we want Obama shooting for Dingell’s record?

Guest-hosting for Rush on Monday, I took a call from Patricia in Indiana, who's just received notice from the IRS that she's going to be audited for her 2013 taxes. Which she hasn't filed yet. Because they're not due until April 15th.

So she's being preemptively pre-audited. It's like the tax collector's version of Philip K Dick's "thought crime": Just in case she's thinking of claiming a refund in a month's time, they need to nip it in the bud now. What could possibly set off such alarm bells? Patricia said she and her husband had an entirely normal, boring tax profile - but they had made a small donation to Mitt Romney. Next it will be the TSA showing up at the door for your secondary patdown even though you've no plans to fly anywhere.

This government is breathtakingly lawless.

That's her right, of course,

True, but just like 'every single US tax-filer signs away his Fifth Amendment rights every April 15th', once waived, that Right cannot be taken back or retroactively affected.

Lerner could either testify or not, but she has no legal right to take the stand to state her innocence THEN plead the fifth - once on the stand, she was obligated to answer.

Arrest her for contempt of court and toss her in a dark, rat infested hole.

The BEST way to “curb IRS excesses” is to replace the income tax with the FairTax and ABOLISH the IRS!

When that is done, we can stop complaining! Until then, we have to complain, and VERY LOUDLY!

Go to http://www.fairtax.org to help us replace the income tax with the FairTax and abolish the IRS.

How do you abolish the IRS without repealing the 16th Amendment to the Constitution, passed in 1913?
Without repealing the 16th, even if we get a fair tax through Congress and signed by some future President, the IRS is still there via the 16th. AND Congress has a Constitutional right to impose an income tax on top of any Fair Tax. As I said, repeal every amendment passed in the 20th Century. Once that is done, we can revisit one or two.
