BREAKING: ATF Raids Ares Armor In Direct Violation of Court Issued Restraining Order

We’ve always said that a restraining order is just a piece of paper. Usually we’re referring to defensive gun uses when we say that. However, in this case we have the government violating a restraining order issued by… the government.

As we reported earlier this week, the ATF has demanded that Ares Armor, along with some other vendors, turn over their customer records in relation to an 80% lower that may have actually been a firearm under law. Ares agreed to stop selling the product in question as well as turn over their stock to the ATF, however they refused to provide their customer records.

Fearing a raid by the ATF after the refusal, Ares sought a restraining in order against the ATF in court. They were granted a restraining order, and both sides were supposed to show up in court next week. However, the ATF didn’t like that one bit. So, what did they do? Oh, just violated the crap out of that restraining order and raided Ares anyway.

I read somewhere that the ATF went back into court for a clarification of the order, and that thereafter, they were permitted to execute a search warrant.

I read that the hearing for same was ex parte.

What gives when counsel is known? Not even a telephone conference for a clarification?

I think the ATF will contend that the receiver is more then 80 percent complete because the void space for the trigger/safety was already complete and filled with another polymer plastic.

1) I believe that is in fact what they're contending.

2) According to Ares, EP foresaw that ATF might say that, and molds the receiver AROUND the plug, so that there is never a moment that the receiver exists as a standalone entity. According to Ares, ATF was made aware of their misconception and forged ahead anyway, as if their idea were correct, as opposed to bullshit.

I read that somewhere, too, but their website lists their address as ‘Oceanside’.

I had read that Ares had some facility in Oceanside, but supposedly the friction over the sign and the municipal Nazis telling them they “didn’t approve” of them or of guns and that they should cease business or risk jail (how’s that for muni megalomania — their whims and preferences can be enforced just like actual laws!) was the city of National City. A fight with that city could certainly have led to a BATF raid of another facility owned by the company.

Eh...I hadn't read that they had 2 locations. It's obvious in Google street view. Whatever I was watching/reading last night got me sidetracked on 'Oceanside'.

I think at that point it would be only fair they raided the premises to ensure that a known terrorist did not receive them.

There are two lessons to be learned here:
  1. Don't buy an 80% lower without a copy of the ATF letter stating that the hunk-o-plastic or hunk-o-7075 is not a firearm. Why not? Because...
  2. The government doesn't follow its own rules.
The ATF letter and a restraining order are only government issued pieces of paper; but, the former is a government issued piece of paper saying that you can do something, not one saying that they can't do something. When the tell themselves "don't do that", they have no problem changing their minds and saying to themselves "oh... all right... go ahead". This wouldn't be a problem except that their courts will look the other way and let them. In the case of the ATF letter, the courts are a little less flexible. For reasons that I really can't explain, they still take the issue of entrapment seriously.

So now that I think about it, there's a third lesson:

  1. Whenever someone tells you "Get the government issued letter for that first", pay cash.
