GOP writes legislation to deny Eric Holder his salary

A Republican congressman has introduced a bill that would stop government paychecks for officials who have been found in contempt of Congress — a move that seems designed in the short term to go after Attorney General Eric H. Holder Jr.

Mr. Holder has refused to cooperate with House Republicans’ probe into the Fast & Furious gun-walking operation, and the House has voted to find him in contempt. Mr. Holder is challenging that vote in court.

But as Democratic Senator Sheldon Whitehouse already pointed out, Attorney General Eric Holder doesn’t follow the law, he advocates a certain point of view.

Like Obama, Holder makes up his own laws as he goes along, abusing power by acting like a tyrant.

The United States Sentencing Commission Thursday unanimously approved an amendment to revise sentencing guidelines for non-violent drug offenders, but not before one commissioner accused Attorney General Eric Holder of having “disrespected” the judicial branch’s role in sentencing reform.

“I regret that, before we voted on the amendment, the Attorney General instructed Assistant United States Attorneys across the Nation not to object to defense requests to apply the proposed amendment in sentencing proceedings going forward,” Judge William Pryor, Jr. said at a public hearing in Washington. “That unprecedented instruction disrespected our statutory role, ‘as an independent commission in the judicial branch,’ to establish sentencing policies and practices under the Sentencing Reform Act of 1984.”

In August, Holder revealed his “Smart on Crime” initiative, which includes recommendations for reduced sentencing, without consulting with the Sentencing Commission—an independent agency within the judicial branch tasked with setting such policies. Although the sentencing reforms themselves were not controversial, Holder’s cavalier approach to separation of powers, including a March memo in which he “instructed the Assistant United States Attorneys across the Nation not to object to defense requests to apply the proposed amendment in sentencing proceedings going forward,” irritated commissioners and alarmed supporters of constitutional separation of powers.

Chief Judge Ricardo Hinojosa concurred with Pryor that Holder is setting a “dangerous precedent.”

Obama will never sign it. Sure it’s feel good, but it is also cover to allow them to avoid exercizing the real constitutional power they DO have to arrest him and Lois.

THAT would accomplish something other than feel good.

I don’t think so. The government is already funded for the fiscal year. Holder will get his cash. This is just some red meat for the GOP base. Reid will never take this bill up and Boehner has preemptively surrendered the House’s leverage points.

It’s for media purposes only, and that is probably a good strategy. It won’t get past the Senate and President, but if it gets a little publicity, it helps inform a few more Americans who aren’t watching the Stephen Colbert show.

When Holder was found in contempt it was legal for him to continue to be paid. Now thay want to retroactively impose a punishment on him for past actions. I think that would fall under the ex post facto restrictions. I think that all they can do is pass a law sanctioning any future cabinet member found in contempt and stripping them of their salary. And I don't have a problem with that.

I’m not a lawyer so I could be completely wrong on this, but Holder’s contempt of Congress is ongoing. It is not a one time action in the past, but is continuing at this moment. Consequently any law that prohibits paying a government official who is in contempt of Congress would apply to Holder because his contempt is ongoing. Even if it were not ongoing, Congress could surely find him in contempt for any number of wrongdoings after the law is passed.
