Driver sues boy she struck and killed

A woman who hit three teenage boys on bikes while driving, killing one and injuring the other two, is suing the dead teen for the emotional trauma she suffered.

Mother-of-three Sharlene Simon, 42, is also suing the other two boys and the dead boy’s family for $1.35 million in damages due to her psychological suffering, including depression, anxiety, irritability and post-traumatic stress.

Cameron has launched a routine lawsuit against the driver, mainly for medical and funeral costs on behalf of the boys and their families. He alleges Simon was speeding and may have been intoxicated and talking on her cellphone.

“Sharlene Simon failed to take reasonable care to avoid a collision which she saw or should have seen was likely to occur,” his claim states. “She operated the motor vehicle while she was intoxicated.”

Perhaps she’s counter-suing. Perhaps this is a pre-emptive strike. Perhaps the boys were 100% at fault.

Perhaps her cop husband, who was following in another car, got her away from the scene, without a test for impairment.

Driver is cop’s wife, whose cop husband was following her. No breath test. No surprise.

This is a counter-suit, which is routine, as defending against the suit is helped by showing that the victims was at fault.

This is total BS, regardless. Any kind of decent human being does not kill someones kid and then turn around and sue the parents. You just don’t do it.

Irritability? I never knew you could sue somebody for irritating you. I almost want to sue her myself because after reading this, I'm plenty irritated and annoyed.

No decent person would sue the parents of a boy they killed - even if it was totally not their fault. This leads me to believe that she has something to hide about what happened that night and this ridiculous lawsuit is a desperate attempt to muddy the waters so that her actions that night are not exposed.

Let's see.. if the boys were not using bike rules (as my boys were taught including wearing helmets which is stupid), I would see that she have a case, bit if she was at fault, she should own up to it.

Here in Tampa, bicyclists (mostly adults of the minority race) ride in the middle of the road and cross the street not at crosswalks. They don't care about rules.

It's just hard to imagine parents suing a driver who had killed their child. Why would they do such a thing? It might inconvenience this poor women and cause her undue stress. She has a life to get on with, after all.

I think a suit like this shows very little character, but I agree there are a lot of bicyclists on the road and on hiking trails that do endanger everyone around them.

It can be a good way to get another person to drop a baseless lawsuit against you...and the sooner dropped, the less you will pay defending yourself. Some people see dollar signs in front of them and forget the cost of losing.

Also, if an insurance company is involved, they might require her to follow their legal counsel.

From what I read about this case in various articles, there may be a case that the boys were at fault. In that case, a counter-suit might be entirely reasonable.
