Federal Judge Strikes Down Wisconsin Voter ID Law

A federal judge in Milwaukee has struck down Wisconsin's voter Identification law, saying it unfairly burdens poor and minority voters.

U.S. District Judge Lynn Adelman issued his long-awaited decision Tuesday. It invalidates Wisconsin's law.

Wisconsin's law would have required voters to show a state-issued photo ID at the polls. Supporters said it would cut down on voter fraud and boost public confidence in the integrity of the election process.

But Adelman sided with opponents, who said it disproportionately excluded poor and minority voters because they're less likely to have photo IDs or the documents needed to get them.

Wisconsin's law was only in effect for a 2012 primary before a Dane County judge declared it unconstitutional.

Actually, you have a very good point. Disproportionate impact is a vile distortion of equal treatment under the law, but if minorities and the poor can’t be expected to show an ID to vote, then how can we possibly require them to present ID for anything else? Wouldn’t that also create a disproportionate impact?

This judge is simply making the law up. Justice Sotomayor tried the same thing recently. How could one write any law that would meet their subjective standard? Too many blacks pulled over for speeding? Speed limits are unconstitutional! Too many women arrested for shoplifting? Laws against shoplifting are unconstitutional!

The disproportionate impact crap is exactly that. Pure crap. It’s simply a tool used by judges to reach a desired ruling, whatever they think is right. It’s not rule of law. It’s rule of whatever the guy in the black robe thinks.

He's indicated he'll likely call a special session to vote on a new law just like the already Supreme Court tested Indiana model.

“Poor” is not a protected class. You’re absolutely right. I don’t see anything in the US Constitution that says the poor (or rich for that matter) get different treatment under the law from everyone else.

Bear in mind that the states have amended the Constitution to protect voting right on the bases of race, sex, tax status, and age as evidenced by 15th, 19th, 24th and 26th Amendments respectively. So not having to show a valid photo ID in order to vote is not a constitutionally enumerated right. So the judge who made this decision is probably an activist judge.

Also note that not having to pass a basic constitutional law test in order to vote, a test which stresses the federal government's constitutionally limited powers, is also not a constitutionally protected right. So there is nothing stopping the states from requiring candidate voters to pass such a test in order to vote imo.

In fact, why not include questions which test knowledge of federal government's constitutionally limited powers a part of a driver's test of road laws?

Funny how the Federal judges go according to Supreme Court opinions when it comes to gay marriage but not when it comes to Voter ID. The US Supreme Court has found that requiring a photo id to vote is not unconstitutional.

But all stops will be pulled by all available parties before November.
