Virginia proposal would limit size of gatherings at private homes

A plan to ban "frequent and large gatherings at neighborhood homes" is a lawsuit waiting to happen, a Fairfax County supervisor predicts.

Officials will get an idea Wednesday when public-comment hearings begin in Virginia's most populous county.

"I believe the county is risking a lawsuit and/or a constitution challenge by interfering with peoples' right to assemble," Supervisor Pat Herrity said in a statement.

The proposed zoning ordinance limits "group assembly" at residences to 49 people a day. Such gatherings "shall not occur more frequently than three times in any 40-day period."

My wife did the census there over twenty years ago. The immigrants pave the front yard for parking and turn every room and closet into bedrooms. Finally they sleep in shifts like the old hot bunks on submarines...8 hours and you get up because someone else waiting.

Stop the home churches, reduce the organized church to a department of the state.

that's is exactly what is at stake here... up until 2-years ago, i lived in the Central Valley in California... we had a 1.5 acre property... we are homeschoolers, and we belonged to a co-op... we would have anywhere from 3-5 families in our co-op any given year... we built a detached classroom and an additional office/classroom on our property... our co-op would meet two days a week... so for 8-10 weeks out of the year, we would assemble at our home (each family hosted the co-op for one quarter)... plus we led a small group which met once a week... and i led a reading group that met weekly in our home... and every so often i would host a homeschooling mothers evening in our home... and from time-to-time i would hold educational workshops on our property... our property was big enough so that no one would park on the street... we lived in a large cul-de-sac with only seven homes where most residence kept farmer/rancher hours and were gone while our schooling took place... it was a perfect setting for our lifestyle at that time in our lives... not this particular law, but laws like the one proposed would hinder our freedom to do what we did...

on July 1,1999, the Front Setback Paving Ordinance went into effect in San Jose, California, for that very reason...

If there's trespassing, illegal parking, disorderly conduct - whatever, then enforce existing law.

But its easier to pass new unenforcible laws.

Ever live across the street from a home church? I have. I can assure you, they find parking spaces.

Hope you don't need to go anywhere while "church" is in service. Getting out of your driveway can be fun.

This is badly needed to target illegals, and their homes which turn into hotels/odd gathering places.

To be honest, this will also end up targeting Asian communities, Vietnameese, Koreans, and even Indians, as these homes tend to have very large gatherings frequently which last late into the night in Fairfax county.

Around the corner from my house is a large home, which has completely paved the entire front yard to turn it into a psuedo parking lot, where the Koreans who live there have large gatherings every Friday/Saturday during the summer. No HOA in my neighborhood (I refuse to live in one) and for the most part the noise is kept to a minimum.

I think it is purely RACIST.

That is going to really, really limit the size of illegal Mexican households here in Texas.

Hell, the drug dealers across the street from me will really be hit hard.

Yes, likely, and I must say I am somewhat sympathetic to the intent.

I live in a very nice, quiet neighborhood. Every few weeks or so, middle of the week, the Mormons across the street host an event. I am talking about an event that has dozens of people show up in dozens of cars. Parking is completely taken over by the visitors. This on a street (cul-de-sac) of 21 homes. Many times the visitors park in front of driveways and block them. Noise is tolerable but trying to drive in and out of the neighborhood is downright impossible due to jammed parking on both sides of the street, and if you do have to leave, don’t expect to find a parking place anywhere near your home when you return. Because we don’t have any side streets off of our street (fields on both sides), and the road our street joins is a divided roadway with no parking, you are forced to park about a third of a mile away at the Walgreens parking lot and walk back on the busy street (or walk in the thistle and weeds—no sidewalk).
The Mormons are always nice about moving when approached to let you out of your own driveway, but come on. . .

You are correct, but the law in question does not make this distinction. The right to peaceably assemble is being infringed by this law. If an assembly is not peaceable, then there are laws already on the books to deal with such gatherings. Those laws should be enforced, but laws restricting the right to assemble based solely upon the activity of assembling (such as the one being discussed here) are blatantly unconstitutional.

How about a wedding reception? An anniversary celebration? Graduation? A major birthday?

I have attended local horse events that were held at one ranch or another. We have had as many as 150 people there, riders, crews, volunteers, people cooking, etc.

This is nuts.

IF it needs to be written about illegals, write is as such.
