Tree trimmer apologizes for Oakland baby bird fiasco

The tree trimmer at the center of a federal and state investigation into the destruction of nests and slaughter of baby birds in Oakland said Thursday that he "screwed up" because he allowed his crews to chain-saw trees even as baby birds were falling out.

Pulido was the supervisor for a crew of tree trimmers hired Saturday by the U.S. Postal Service's Civic Center Annex in Oakland. The post office ordered trees containing the nests of egrets and black-crowned night herons, species protected by the U.S. Migratory Bird Act, to be cut because the nesting birds were defecating on mail trucks.

Post office: No birds hurt

U.S. postal officials continue to deny that birds were harmed in the course of the tree trimming. A postal maintenance worker observing the tree-trimming on Saturday reported that no birds were injured, said U.S. Postal Service spokesman Augustine Ruiz.

The U.S. Migratory Bird Treaty Act prohibits tampering with nests of migratory species. The trees in question were laden with dozens of nests, baby birds and their parents.

As Pulido and his crew cut through the trees with chainsaws, horrified neighbors tried to stop them, ultimately calling the Oakland police. A video shot by a neighbor shows workers sawing large tree limbs and feeding them into a wood chipper, and a baby bird flapping on the ground.

The injured birds at International Bird Rescue, and a dead bird photographed by The Chronicle, must have been hurt in unrelated incidents, Ruiz said.

The post office is at fault here. Anyone who lives or works in downtown Oakland knows that the birds nest in these trees in springtime. If they had waited a few months the baby birds would have been gone. Idiots!

Let's not tar and feather the tree trimmer and please let's leave his family alone.

People are murdered in Oakland right and left, but the only thing that gets people upset are baby birds.

I used to live two blocks from this spot. Had I been walking by and seen this I probably would have been arrested for interfering with a tree trimming operation.

Don’t we kill baby birds every morning for our breakfasts, or, in typical California fashion, is it ok to kill the unborn birds but not the post birth ones?

Wasn’t there a story recently that there had been more abortions performed in the San Francisco area than there had been births?

If any landowner did what the Post Office or its tree trimmers did, there would be a Bundy-ranch-scale FedGov SWAT team gunning for them, tazing their women, and generally destroying his and his family's lives.

FACT, agreed.

USPS is at fault. USPS is a gov’t agency that should be expected to adhere to regulations. DC’s / Gov’t-outa-control entitlement mentality, “We’re too important to adhere to these rules, they’re just for little people” has a trickle down effect.

I wish the tree trimmer had flatly refused - I wonder what, how much was said in planning this job?

Don’t worry. Once the EPA jams the new “chainsaw emissions control computers” down everyone’s throat, the working peasants won’t even be able to get their chainsaws started, and the baby birds will be safe.

To reference my previous about the new EPA "chainsaw emissions control computers" - of course, the government won't have to eat its own emissions cooking.

They'll just buy $12,000 chainsaws after stealing moar money from the taxpeasants at gunpoint.

The $12,000 chainsaws will use the $150 a gallon greenie jet fuel...

The neighbors were rightly horrified:

As Pulido and his crew cut through the trees with chainsaws, horrified neighbors tried to stop them, ultimately calling the Oakland police... "I waved at the workers and said, 'Please, for the love of God, stop,' " said Cat Callaway, 27, a landscaper...who took a video with her phone..."

The USPS is responsible for this -- not only the blatant disregard for migratory regulations, but for breaking city codes as well.

It's just too bad the tree trimmer is the focal point of anger and (hmm) fallout, though he should have refused to be part of this. Did he not think about fines, if nothing else?

The tree trimmer was hired by the GOVERNMENT. The USPO should be held at fault, but they are happy to let this guy take the fall. The govt seems to think they get to make the rules but they get to break them with impunity.

Needing a new Constitutional Convention here. “All laws apply to all people.’ Something like that. “No one is above the law.” I was sure that had been covered in the Constitution??

We cut four last weekend. One was a significant risk of a deadfall, with injury or property damage, depending on which direction it fell. All four were dead (bark beetle). None had nests, so down they came. The single, live neighbor we left is recovering nicely after a good watering. We'll see if the beetles kill this one off. They're trying, but we're gonna fight 'em.

If they were pines, the primary means of a tree acquiring bark beetles are the scent of the terpines emitted from freshly cut or trimmed local trees...
