Boehner: House won't arrest Lerner

The House has held Lois Lerner in contempt, but it won’t use its power to place the former IRS official under arrest, Speaker John Boehner (R-Ohio) said on Sunday.

Under a precedent affirmed by the Supreme Court, each chamber of Congress can authorize its sergeant-at-arms to detain individuals it holds in contempt. But Boehner said on "Fox News Sunday" that he has no interest in doing that with Lerner, whom the House last week voted to hold in contempt over her refusal to testify about her role in the IRS’s targeting of conservative groups.

“I’m not sure we want to go down that path,” Boehner said. “It’s never been used,” he said of the provision allowing Congress to arrest individuals and place them in the Capitol jail. The Senate has in fact used that power, but not in the last 80 years. “I’m not sure that it’s an appropriate way to go about this,” Boehner said.

The contempt charge has been referred to the Justice Department, and Boehner said it is up to Attorney General Eric Holder to prosecute Lerner.

“Now will he do it? We don’t know, but the ball is in his court,” Boehner said.

The U.S. attorney’s office in Washington has said it is reviewing the referral. Lerner has repeatedly invoked her Fifth Amendment right against self-incrimination, but the House contends she waived that right by defending herself in an opening statement at a House hearing last year before she refused to answer questions from lawmakers.

No, not him, the US Attorney in DC SHALL bring the matter before the appropriate court for consideration.

The Republicans simply do not have the power to render justice to Obama’s commissars. The commissars know they will be protected by Obama and Holder. Boehner needs to be more creative.

The House Boner fails to rise to the challenge ... again. Why even bother with a contempt vote if you're not going to enforce it?

Just another example of why no matter how many conservatives are elected over RINOs/GOPEs, if the leadership doesn't change not much else will.

And we need to remind both parties that we will continue to demand justice after the elections so they may as well get with it.

Too often things like this have been allowed to slide down the memory hole because we won and the urgency went away.

So, Speaker Boner, if I guess that Holder won't do a thing about it (and I KNOW that I will be correct), does that mean you will resign? After all, if I, a nobody, bests you on political insight, maybe you ought to get lost.

Okay. So now we know that the FBI is afraid of Obama’s IRS and will not arrest anyone for breaking the law with their attacks against the American people. Now we see the GOP is also afraid of Barry’s IRS and is not going to arrest anyone for breaking the law. Don’t tell me that ObamaCare is “the law of the land”. Same goes for “gun control.” I don’t want to hear it. We don’t do laws in America anymore.
