LA Clippers owner Donald Sterling mentally unfit, can't stop sale

..., Los Angeles Clippers owner Donald Sterling has been ruled mentally unfit and cannot stop the sale of his NBA team.

It was announced late Thursday night that Donald's wife Shelly had reached a deal with former Microsoft CEO Steve Ballmer to sell the Clippers for a record $2 billion. According to ESPN, the papers were signed shortly before midnight.

So he was mentally competent enough to be fined for making racial statements in private, but he is not mentally competent enough to stop the sale of his property. This really sounds like the old Soviet Union or some other fascist country.

It's in the article:

The rules of the Sterling family trust did not require a court to declare Donald Sterling mentally incapacitated.

If this is correct, the family trust apparently has a clause that allows a trustee to be declared incapacitated. I'll guess that Donald and Shelley were co-trustees, and declaring him incapacitated left her in control.

He will still be a beneficiary. But, she is now "driving".

So now that Sterling is officially "mentally competent", does that mean that Shelley can sue anyone who describes him as a "racist"? She does seem to be a woman who will exact revenge in financially rewarding ways.

(PS: I like that you said "racial" instead of "racist". What Sterling said wasn't racist it was jealousy)

Just wait till the “Swiss Law” about assisted suicide in which the victim (”patient”) does NOT have to be suffering from an “incurable disease” kicks in. Then family members will be able to have anyone killed who stands between them and their money. See: the Disney family fight, in which one of the grandsons was basically a prisoner of the other family members.

Some shrink at the request of the family I assume. I don't think this kind of determination happens in a hurry. His wife has probably been working on having him declared mentally incompetent for some time now.

To have this happen (your rights taken away), “mental incompetency” must be adjudicated by a court of law with due process. In Sterling’s case, he evidently met the definition for “mental incapacity” as per the Trust agreement he signed, not in a court of law. This is often two (maybe more) doctors agreeing and signing off that you do not have the “capacity” to make decisions of a certain type ... medical, financial, etc.
