This case was pretty amazing —the guy was lying on his stomach cuffed and the unjostled, calm officer somehow triggered his gun.

Really, really caused the stuff to hit the fan in the San Fran Bay Area, at the time.
The incident inspired a whole movie, “Northdale Station”, or something like that.
Hard to feel sorry for someone for being so incredibly incompetent. But the civil rights charges just seem like BS to me.
There is stupid.

Why is that? This moron killed a man while wearing a government issued uniform, badge, and gun through sheer incompetence. He is being sued under a section of the Civil Rights Act. He’s damned lucky he wasn’t prosecuted under the criminal section of the US Code, 18USC242 which in my opinion he still should be.
He could have gotten the death penalty.
I would think that even just Tasering a suspect in that position would be questionable.

Yes, and it wasn’t like people were running around. There was minimal confusion, good lighting, no individuals were fighting —the officers had 4 suspects sitting off to one side, isolated from others, etc.
The officer had had the guy at gunpoint probably for almost ten unhurried seconds.
The movie name was “Fruitvale Station” —I got that wrong.
I remember the original news video and the amazing tension at all the B.A.R.T. stations after that incident.

One of the original BART killings that was really controversial was the killing of a UCSF neurosurgeon of quite some reputation at the Daly City BART station —very, very similar circumstances shortly after they first made the special BART department.
I don’t have any earthly idea of what was going through his mind, but it looked a lot like the officer simply got an impulse to shoot someone.
That does sound ridiculous, and I disbelieve that, but I saw that video maybe 20 times and each time that’s what it looked like.
Simple finger twitch? I have no idea, even now, years later.

I believe the cop got off way too easy.
But the civil rights charge implies that he shot the kid out of anger or bigotry. So I guess we’ll just have to see what kind of evidence they can produce. Has this cop made any racist statements in the past, or does he have a history of violating anyone’s rights?

Wrong statute. Go find the Civil one.

Go find the Statute. What was or was not in his heart isn’t relevant to the discussion. He wrongfully deprived a man of his civil right to remain alive. That is beyond question.
He should die broke in the streets.
