Plymouth man arrested for threatening wife with toy gun

PLYMOUTH -- A Plymouth man was arrested late Tuesday after allegedly threatening his wife with a toy gun. According to a release from the Marshall County Sheriff's Department, officers were called to a house in the 13000 block of Nutmeg Ridge Drive shortly after 11 p.m. Tuesday on report of a man threatening his wife with a gun in the presence of a child. Officers talked to the man who admitted having a toy gun, according to police. David A. Tanner, 46, was arrested and charged with intimidation with a deadly weapon. Tanner was booked into the Marshall County Jail on a $1,500 bond.

I’d like to be in the courtroom to watch how the prosecution makes its case that the toy gun is a “deadly weapon”.

Is he gonna try to shoot someone’s eye out with a nerf dart?

You don’t have to have a real weapon, you just have to try to make someone else believe it is a real weapon.

The prisons are going to be full of children who are caught having water pistol fights, that is if they aren’t shot dead by the swat team.

It all sounds very silly, very stupid, but these days, there are long guns that look very much like the real thing from a distance. A few months ago, a 13 year old boy would not drop his BB Gun, when asked to by an officer. Instead, he appeared to point the BB Gun at the officer. The boy was shot and dropped right there on the street.

If you add the speed of brandishing plus the fright that comes with surprise, I can see why she may have been fooled. What I can’t see, if why she had to get the police involved, unless they were already not getting along, and all spousal trust has been forever lost. Otherwise, lighten up, lady!

Just about anything you can hold in your hand can be used as a deadly weapon. I guess they would have to prove intent.

I read when some of the crooks are using a black marker and covering up the orange. No doubt their defense, upon being shot, will be "It was only a toy". They should get extra time for covering up the tip.

It is my understanding that if the victim thinks it's a real gun, the situation is treated as if it was - an eye of the beholder thingy.
