Smoking is an addiction. Addictions are disabilities. Smokers should sue under the Americas With Disabilities law.

This is ripe for a lawsuit.

It has already been litigated and the smoker lost.

It turns out that employers have an interest in hiring people who have fewer sick days, lower insurance costs, and no smoke breaks. Smoking stinks, the smell affects people with allergies, and it a major turn off for many customers and clients.

Smoking is a voluntary choice, and no one owes anyone else a job when they make choices that will almost certainly negatively affect the employer. I quit nearly 12 years ago, and would not have ever thought to demand to be put on equal footing with a non-smoker in the job market.

Well just switch to marijuana then one can get high and relax. I don’t see it singled out.

In Colorado, the amendment that legalized marijuana specifically spells out that there is no carve out for dope.

Employers can test and fire for it at will.

I grew up in Southern Maryland, working as a kid on my Grandfather's tobacco farm.

Tobacco was the cash crop that sent children to college, fed families on 5 acres of land, and for many a source of employment--not to mention the work ethic developed by countless children who worked in the fields of the family farm.

Now, I doubt there are a dozen tobacco farms left in the state.

Sadly, that removes the 'excuse' that the nicotine in a person's system is just transdermal absorbtion from working in the fields.

Yeah, I was thinkin’ the same thing. I guess screening for behavior is gonna be the next qualifier for job applicants? Politically correct “behavior” okay. Non PC behavior, no job. See. They have their ways of forced compliance. Do you believe in glow-bull climate discombobulation? You’re good to go. Are you a denier? Sorry. Do you surf? Have you ever pee’d in the ocean? No job. Gun owners need not apply. This could go on and on.

What a moronic statement. Statism has directly caused 120 million or so deaths, so your proud claim to preferring to be a statist is actually an admission that you ARE a pimper of death.

Well, that’s the only time in Maryland’s history that a court came down on the side of the employer in recent times; I am sure just to continue the liberal states war on tobacco. The hypocrisy is that this same argument can be made for other legal practices such as drinking alcohol or other risky behaviors, which I am sure that Maryland will ignore.

Drug users have been beating these tests for years, wont be any different for smokers.. and the good part is, the harder the anti smoking nuts push, the better chance a law will be passed to make this kind of discrimination illegal.
