Boehner: House GOP files Obamacare suit

House Speaker John Boehner said Friday he has sued the Obama Administration in federal court over its decisions to make changes to the President's health care law, which congressional Republicans argue were unconstitutional.

The move was expected for months -- the GOP-controlled House of Representatives voted to approve the lawsuit in July. But Boehner had trouble retaining a law firm that would take the case because of the political furor over the controversial health care law.

"Time after time, the President has chosen to ignore the will of the American people and re-write federal law on his own without a vote of Congress. That's not the way our system of government was designed to work," Boehner said in statement on Friday.

He added, "if this President can get away with making his own laws, future presidents will have the ability to as well. The House has an obligation to stand up for the Constitution, and that is exactly why we are pursuing this course of action."

Impeachment is a bad idea. It’s almost certainly doomed, and even if it succeeds, what’s our big prize? A few months of President Joe Biden before the new president is inaugurated. In the meantime, any impeachment effort, succeed or fail, would imperil our attempts to take back the White House from the Democratic Party; it might even cost us the 2016 election.

But some conservatives are too busy venting their emotions against Obama to be logical.

What does the Senate have to do with impeachment? Nothing. The House does its thing and the Senate does its thing. If the Senate chooses to leave him in office so be it. Doing something including doing ones duty to uphold the Constitution is reason enough. Plus the high crimes are documented and placed into the history books as he would be the 3rd President to be impeached.

Impeach. Repeat as necessary

That is just plain stupid. Does anyone really remember Clinton being impeached? It is a horrible strategy unless you have a good chance in the senate.

Congress needs to declare war on the Executive branch and use every tool and trick at their disposal and pull out all the stops to put these antiAmerican pos in their place. Should've been done years ago.

OPEN LETTER TO SEND TO YOUR CONGRESSMEN

Dear Hon. US Representative ...,

Sir, what the President has done yesterday, and not for the first time, has issued an Executive Order to violate the law!

In accordance with the Constitution, federal law can only be enacted, changed or repealed by an Act of Congress passed by Congress and signed into law by the President, or passed by Congress alone via an over-ride requiring 2/3 majority in both Houses.

Executive orders of the President cannot be used nullify, amend or create federal law as that violates the Constitutional separation of powers. They can only used to specify actions within the President’s authority to act. Furthermore, a decision NOT to enforce a federal law (e.g. DOMA) is a violation of the Constitution.

The only recourse Congress has is to impeach. Furthermore it is not an option - it is a requirement, otherwise Congress becomes complicit by endorsing the President’s lawlessness through inaction.

If Congress does not step up and do it’s job, then We the People of the United States will lose our freedoms, our rights and the protections afforded by the rule of law.

Sir, I’m imploring you and others in Congress put pressure to begin impeachment proceedings in the House Judiciary Committee to put a stop to the lawless, imperial Obama Adminstration.

Prof Rob Natelson, conservative Constitutional scholar, says that the 3 Constitutional courses of action are: lawsuits, defunding, or impeachment & trial. I have no problem with pursuing all 3. The most likely to succeed in order are: (1) defunding (GOP has both house and senate), (2) lawsuit (possible victory in a possible fair trial), (3) impeachment & trial (conviction at trial not probable given division of power in the US Senate.)

Yeah, I think the Bassett Hound should be encouraged to think about impeachment. I simply don’t care what happened to presidents in the past, not all grounds for impeachment are the same and Clinton was way more popular as POTUS as Obama ever was. Get the RINOS and the Democrats on record.
