10 states line up to limit federal power
WND ^ | 20 January 2015 | Paul Bremmer

Ten states now have taken the first step toward limiting the power of the federal government. Officials from Arizona, Massachusetts, Missouri, Montana, New Hampshire, New Jersey, North Dakota, South Carolina, Virginia and Wyoming have filed resolutions calling for a convention of states that would propose amendments to the U.S. Constitution with the express purpose of limiting the power and jurisdiction of the federal government. Article V of the Constitution gives the states the power to call such a convention. The article reads, in part: “The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress.”

At least for MA, be aware it is HD2552, a house bill now in the hopper. Still has to get thru the Sinate. Depending on what step this is, perhaps it need not have a gov signature, if the actual call (the legislatures are the sole driver of Article V from the states).

I’m praying that these measures bear fruit, for I have no confidence in the Federal Government or the Courts to do the right thing.

Sorry, you’re way off on that. You ignore the 17th Amendment which cut the cord of States power in Congress. The result is that a hundred years later the States have no influence in Congress, and thus no check on federal government.

The solution is not necessarily to repeal the 17th but there is a solution nevertheless.

What we do not have is Courts or a President willing to do it.

What we don't have are States willing to put their foot down and insist - including chasing Feds out and ignoring warnings/threats.

"10 / 34 ≈ 29.4%"

Don't forget the 3 that have already passed! That makes 38%

Perhaps more relevant at this time would be the anti-federalist papers.

Lets’ see is that a total of 13? Sounds like the start of a revolution. Let’s hope so. A revolution FOR our Free Constitutional Republic under the Constitution and AGAINST the illegal, unconstitutional part of the federal government.

Looks like 21 more to go to make our 34 total necessary to meet the 2/3’s requirement.

Correct. If we only get one amendment the repeal of the 17th is probably the most important. Second to that is a nullification process for federal laws and federal court decisions. Third elimination of the income tax amendment and elimination of the authority of congress to write national tax law. Replacing the income tax with a national sales tax of say 10%. Prohibit transfer payments of any type by the federal government. There are other changes that are needed but these IMHO would fix our problems. And it is important to note the problem is not the constitution but our corrupt government and people.

It may never pass your State house, not unless the filers there convince the State legislator it would be an opportunity to take a 2nd look at unwanted Federal intrusion injuring their ability to compositely subjugate the population.

In any even Massachusetts is perhaps first on the list of 14 states we don’t need or really want at the convention.

I would accept any and all measures you just proposed, and thou I might agree with your prioritization of their resistances I also believe we must take whatever of them we can get.

In general however I don’t believe the 17th Amendment is more important than a nullification process which should require not more than 1/3rd of the states in veto of a edit.

The laws of a Constitution of limited Government are by nature designed to protect the minority.

The truth is we don’t need the Federal court system involved in any intrastate domestic matter period just like we don’t need or authorize congress in such matters.

We the people have labored to create State Constitutions and elect State and Local governments for this matter. The Time, attention, and resources of congress should be focused upon foreign matters which have been sadly in Gross neglect.

"Third elimination of the income tax amendment and elimination of the authority of congress to write national tax law."

Given the remote possibility that you haven’t seen the following excerpt, you might find it interesting. The corrupt feds now wrongly ignore that the Supreme Court has historically clarified that Congress cannot lay taxes in the name of state power issues, essentially any issue that Congress cannot justify under its constitutional Article I, Section 8-limited powers.

“Congress is not empowered to tax for those purposes which are within the exclusive province of the States.” —Justice John Marshall, Gibbons v. Ogden, 1824.

I don ‘t have any problem with what you propose. I think repeal of the 17th is doable in the short term. Nullification is a longer term issue. The people have to be readied for it. As far as the federal courts are concerned I would eliminate judical review. That would fix the problem with them in short order.
