I watched the video. I see no way to call this a good shoot. He will have his day in court. He will go to jail and do hard time.

Trying to defend the shooter cop in any way is nonsense.

Protests start at North Charleston City Hall in less than a half hour. Not much to loot there and it’s close to the main police station. Local Charleston SC news will break in with live coverage. Where he was killed has plenty to loot and burn. Map here;

“I suspect we will get some more Ferguson style entertainment out of this.”

“North Charleston is South Carolina’s third-largest city but bears little resemblance to its more scenic neighbor to the south. Over the past two decades, as Charleston has emerged as a foodie’s paradise of restaurants and boutique hotels, North Charleston suffered massive job losses with the closure of a naval base. As housing prices went up on the Peninsula, as Charleston is called, many African Americans moved to North Charleston.

“What has happened in Charleston proper is that there has been a lot of gentrification,” said Bernard Powers, a history professor at the College of Charleston. “A lot of people have been pushed out of downtown Charleston and will frequently move into the adjacent area of North Charleston.”

Today, Charleston and North Charleston are starkly different cities. Only 25 percent of Charleston’s population is black, compared to 47 percent in North Charleston. Per capita income in North Charleston is just 61 percent of that in Charleston, according to U.S. Census data.

As in Ferguson, Mo., however, those demographics are not reflected among the ranks of North Charleston’s police. According to the Post and Courier, roughly 80 percent of its cops are white.”

“Dead man was retired military.”

Anti-Military President Bill Clinton closed the Navy Base in 1996.

Base Closure

“The Charleston Naval Base remained the largest employer of civilians in South Carolina into the 1990s. The influence of Lowcountry legislators and the threat of nuclear attack played an important role in keeping Charleston’s base open in the face of periodic attempts at closure.

However, in the early 1990s, with the resolution of the Cold War and impending defense budget cuts, Charleston’s Navy Base was once again on the chopping block. In 1993, the Charleston Naval Base was given a closure date of April 1, 1996. The closing of the base was a blow to Charleston’s economy. Over the years, millions of dollars flowed into the Charleston area economy and hundreds of thousands of jobs provided to military and civilian personnel, the vast majority being civilians. Many military personnel who worked at or passed through the base returned to Charleston to retire. Since the closure of Charleston Naval Base, parts of the base and dry-docks have been leased out to various government and private businesses and community parks have been established on old base grounds.”

'Gentrification' when blacks leave a downtown area, 'white flight' when whites do it. Gotchya. Either way, the economic decisions are assumed to be racist. Great.

Today, Charleston and North Charleston are starkly different cities. Only 25 percent of Charleston’s population is black,

Only? America is 14 percent black. A city at 25 percent is 78 percent above the national average.

Looks like the cop was angered by his suspects resistance and/or verbal incitement, and vented on him. It looks like second degree murder is the appropriate charge, and it might get downgraded to manslaughter if they buy that he was following Department escalation procedures, and then wrongfully opened fire due to excessive passion from a struggle.

They were away from the vehicle in the traffic stop, indicating that the suspect walked away from the vehicle and was being non-compliant. It must have gone on for some time, for the incident to draw spectators to film it - probably some shouting, possibly some scuffling.

If the suspect assaulted the officer prior to the video starting, he may have been fleeing a felony, which puts the shooting on a different legal footing.

There are escalation procedures for subduing a suspect, e.g first give a command, second attempt to physically compel compliance or apply a restraint (handcuff), third might be non-lethal incapacitation like pepper spray or stun gun, and finally the use of lethal force.

After the stun gun was deployed, the gun was the next and last escalation step. Clearly, the cop was not in danger when the suspect was running away, so self defense will not fly to justify the shooting. If he was legally authorized to shoot to stop a fleeing felon, he might beat the murder wrap on that basis.

It is pretty clear that he tampered with the evidence, planting the stun gun near the suspect (a time-honored technique - many cops used to carry a small back up gun available to plant on anyone they might shoot). He might have also (likely) made false official statements which could get him fired, and possibly another criminal charge. The fact that he has already been fired, indicate to me that he did lie.

In this case, I think that the officer is likely to go to jail for a long time. Many sentences are tripled on law enforcement personnel who are found to have violated their trust.

This is clearly a much more serious incident than Ferguson, which was a complete fraud against an innocent police officer, or the Staten Island incident Eric Garner, where a suspect resisting arrest died from a heart attack and positional asphyxiation while normally restrained, due to his obesity.

I have a friend who lives on the water there. My honeymoon was in Charleston 26 years ago. It’s changed.

I think that what is REALLY important is for those spokespersons on the Right (including us) to be VERY supportive of this family and of charges against this officer... and to be very clear that this is VERY different from Ferguson, and that all comparisons to Ferguson are not apt. The white officer CLEARLY deserves charges here, and we need to be on board with that... but also clear in noting that this does not mean that all non-black cops that are forced to shoot a black suspect are guilty of murder. Only in THIS kind of case is that true.

worthy of many reposts...

When we can't even call a clear excess of state power what it is for fear that some sleazy character might use the example to get off, then we have failed. The Left never loses sight of their organizing principle - Expand the State - no matter much their factions might hate each other...

Conservatism should be about conserving the radical spirit of Liberty laid down by the Founding Fathers.

Regardless of my skin color the man has the right to a fair trial in a court of law for that is the American way, with that being said this is not a good shooting granted running away from a PO is not a great idea but unless the person was a physical threat to the PO deadly force is the last option you ever should use. This is half the reason why I think every cop should have a camera and mic on them on all times, no questions asked about it.

I agree, use of force policies are strict for a reason, and they are talking about the death penalty for this guy, first I have ever heard about a cop that might be sentenced with that.

Watching it now. Estimates of 40 to 60 people and the reporter even admits that many are the media.

North Charleston Police Chief just reserved comment on camera but did say that he’ll answer questions at a 1:00 press conference.

Seeing no wide crowd shots but expected that.

Protests start at North Charleston City

Sounds like CNN is going to cover that. It will be hot in the news cycle until Friday. There will be near unanimity that murder was done.

But, the underlying hatred of law and order from the usual suspects will endure.

This will be used as supporting the idea that white cops are first and foremost hoping to kill black people every time they hit the streets.

Good shoot? The man made no advance at the officer, and in no state in America that I am aware of is an officer allowed to shoot someone in the back running away.

This is murder, and the cop should fry.

Sorry, that is NOT the rule of the law unless you live in France. It is murder to shoot a fleeing suspect in the back.

'I’m not a trained police officer and I would not shoot a person who was already out of my yard and running in the street away from me. They had the man’s information. They know where he lives and works. They had his vehicle. Where was he going to go?'

That is why training is needed to take over the gut emotional reaction of force.

It is easy to see people resort to violence over a stupid parking space at the mall.

Now, throw in a violent confrontation with another individual. The emotions at times cloud judgement, by both men. People decided to flee or fight.

Training tempers such reactions, and create 'logical'[SOP's, don't shoot fleeing person] responses.
