With this Supreme Court, including Roberts and Kennedy, forcing people to pay for stuff they don’t want, like Obamacare taxes and union dues and their Kelo properties, is their belief.
Don’t count on this Court to help the people on this one.

Government support of labor unions against everyone else has been one of the core power supports of “Progressivism” since the FDR regime implemented it.
If the court votes to uphold the Constitution, this will be a cut at the core power of the left.
I remember when the government employees were not required to pay dues in Wisconsin, something like 70% opted out.

Public sector unions should absolutely be disallowed.
Private sector unions? Probably not constitutional to disallow them by law. So, hey, knock yourself out if you think you can hold a union together — WITHOUT government coercion on your side. But they know they can’t anymore.

It is called extortion and the unions have gotten away with this crime for near a century.
Has it ever been taken to the SC?
I don’t know if the Supreme Court has ever been consulted. I don’t know of any restrictions on public sector unions in the constitution, and they are obviously allowed by statutory law, so I’m not sure how the idea could be adjudicated.
