Sidestepping Apple dispute, Obama makes case for access to device data

AUSTIN, Texas (Reuters) - U.S. President Barack Obama on Friday made a passionate case for mobile devices to be built in such a way as to allow government to gain access to personal data if needed to prevent a terrorist attack or enforce tax laws.

Speaking at the South by Southwest festival in Texas, Obama said he could not comment on the legal case in which the FBI is trying to force Apple Inc. to allow access to an iPhone linked to San Bernardino, California, shooter Rizwan Farook.

But he made clear that, despite his commitment to Americans' privacy and civil liberties, a balance was needed to allow some intrusion when needed.

If Obama had exhausted all other efforts to fight terror and the only option left was access to device data, then I would at least listen to the argument.

...but Obama has done no prerequisit work. In fact the opposite is true.

His hatred for America is transparent.

I am of the opinion that ANYTIME the government wishes to violate the People’s rights, the doctrine of strict scrutiny should be applied.

That ‘treasure trove’ of ISIS files from Europe will be cited as the type of info on that phone.

I say that phone is empty. Maybe they even know it.

But we MUST have access.

How many GB of data are contained in the human brain? You will have to waterboard me.

Kingu is absolutely correct. Encryption of communication is a glimmer of some small restriction on government power.

Now where did I read that? Oh yeah, the Fourth Amendment. Not satisfied with trashing the First (just try to criticize a muslim or gay), or the Second (too many examples to name)... They're now chipping away at the Fourth. Fascist statists will always want more power, more control.

The original authors of the Constitution did not think they needed to enumerate the main rights that were retained by citizens because the Constitution never gave power to the federal government in infringe upon them. Then the argument prevailed that yes, those rights must be enumerated to prevent government from infringing them.

For years it was clear that but for the Second Amendment, government would have long ago destroyed the right to keep and bear arms exactly like it is doing in California today. Now it is going down the exact same road with respect to the right of the people to be secure in their persons and papers, the heart of the Fourth Amendment.

I hereby reserve my rights under all the Bill of Rights! I will take steps to be secure in my person and papers.

Just as we had vigorous and mostly successful activism at the state level to secure the RKBA in the States, the time will soon come when we must repeat this activism for the right of privacy.
