Rochester judge accused of drunk incident: 'You can't (pepper) spray me, I'm a judge'

Rochester City Court Judge Leticia Astacio has been accused of another drunken incident after her DWI conviction last year.

Marketplace Mall security guard Alan Pimm responded to a complaint of women refusing to leave an employee bathroom at the Papaya Asian Kitchen and Bar in November.

"That's when one of the females stated, 'You can't (pepper) spray me, I'm a judge,'" Pimm told police, according to his Nov. 29 deposition. "At that point I could tell she was intoxicated, due to her slurred speech and lack of balance.

Pimm, who says he told them to leave while holding a vial of pepper spray, said he recognized her as "Judge Astacio."

Pimm's testimony was made public in a court filing after Astacio was accused of violating the conditions of her drunk driving sentence for a third time. Astacio was stripped of her judicial duties, but not her title or $174,000 salary, after being found guilty of driving while intoxicated in August.

THREE DWIs that would get any of us thrown in jail....It does not say she three DWI’s. I says the third violation of her probation/ court order. She probaly was told to stay away from alcohol. Ir is apparent she hasn’t.

I wonder if the defendants in her court room the last few years will file some sort of petition for new trials? A judge makes legal decisions during trials and it appears that she has an alcohol problem.... then those she judged should be given fairness IMHO.

When I moved here I was a junior in HS and - with the draft (and VN) hanging over my head - I partied my @ss off for the next two years.
Most distressing about the city's ultimate demise was that Rochester was my mother's city, she and my grandparents grew up in the city.
To see all the great places they knew and loved slowly destroyed was torture.

I live just 40 minutes east of Rochester and was a long time Rochester resident. This affirmative action “judge” was nasty to anyone who wasn’t minority. And that’s a fact.
Same “above the law” ‘tude as your average leftist

Obama put the most liberal lawyers on the Supreme Court he could find. We need to do the same. It’s nuts for us to play by the rules while they cheat.

Find conservative activist judges and put them on the bench up and down the system... now and forever.

Getting rid of the ‘activist’ and replacing them with fair and impartial judges is better.
Just like replacing propagandist journalist with real journalist who report the facts is better.

You're right.

It's past time to lift the veil of the judicial system... they're receiving more respect then they deserve. One team attempting to play by the rules and one team cheating creates a game theory situation where the cheaters win - - NOT healthy for a free society.
