Tommy Robinson FREED on bail (trunc)

Former English Defence League (EDL) leader Tommy Robinson was freed on bail today after his 13 month jail term for contempt of court was quashed - but his case will be re-heard again.

The far right activist, 35, has been in prison for two months after being locked up in May for filming defendents involved in a criminal trial at Leeds Crown Court and broadcasting the footage to 250,000 people on Facebook.

The activist, whose real name is Stephen Christopher Yaxley-Lennon, successfully appealed against his 13-month jail term for contempt of court claiming it was 'excessive' and the hearing was 'rushed'.

Lord Burnett said today the Court of Appeal was allowing his appeal 'in respect of the committal for contempt at Leeds Crown Court' - but said the case would have to be be heard again.

Robinson was not present for the ruling and is expected to be released from prison later today.

The decision send him to prison has sparked several protests all over the country and the campaign to get him freed has garnered support abroad, especially in the United States.

It’s not really over. What they are saying is that the original judge technically screwed up, and the case must be tried again (fresh new judge). He could be sentenced to the same crime again. As for the original judge? To suggest he screwed up would bring up competency comments and I suspect that he’ll retire within six months.

Folks, this is what the police state does. The punishment is the process. Tommy will ultimately be found not-guilty of the political, made up crime that the police state imprisoned him for. However, the punishment was already levied when he was incarcerated and then transferred to a muslim majority prison where he could easily have been murdered.

We must fight against the police state because this is the direction the United States is also going.

"This morning, the Lord Chief Justice's ruling in Robinson's appeal underlined that the Rule of Law - the rules that apply to us all - must be applied fairly in all circumstances.
And that's why the Court of Appeal ruled that Robinson's second conviction in a year for Contempt of Court was flawed. In essence, the five hours from arrest to sentence at Leeds Crown Court was rushed.
Robinson wasn't told what specific parts of his activity at the court had been potentially prejudicial to a jury - meaning nobody to this day knows exactly what he did wrong.
Further, he immediately removed the offending video from Facebook on the court's order and the judge should have then adjourned the matter to give him longer to prepare a defence.
Tommy Robinson is still convicted of contempt in relation to his behaviour at Canterbury last year where he received his three month sentence for potentially derailing a fair trial.
Today, the Court of Appeal said that very same right to a fair hearing means Robinson should have a full opportunity to put his case without rushing to judge.
At an earlier hearing, Robinson's QC argued that procedural "deficiencies" had caused "prejudice" in Leeds.
Lord Burnett said the judge should not have commenced contempt proceedings the same day he was arrested.
He explained "no particulars of the contempt were formulated or put to the appellant", and there was "a muddle over the nature of the contempt being considered".
My emphasis - after this admission I don't see how any fresh hearing could be fair, and it should also give Tommy grounds to sue.

The problem is what he did. He is guilty of that even if it was a trumped up charge. The punishment was WAY too extreme. They were trying to intimidate anyone who opposes the government.
Meanwhile, the other guys are killing and raping with no punishment.

Scary stuff.
