This is far beyond just mere legislating - he is claiming for himself both the powers of Congress and the powers of the Presidency. First of all, it was an illegal and unconstitutional program to begin with not authorized by statute of Congress (indeed, prohibited by it) as openly admitted to by the President who signed the order. Nonetheless, let’s say theoretically that is not the case and it was legal and Constitutional - it was still a purely executive action - not mandated by any statute. Purely a policy put in place by the executive - the President. The President now rescinds the order - and judge has now ruled and Executive Order must be reinstated that was rescinded. The judge has absolutely no power to do this. This is not merely a decision a judge has made that we disagree with - the judge has usurped the powers of separate branches of government and claimed them for himself. This judge is the most powerful entity in the country if this is allowed to stand. This kind of a ruling is an impeachable offense in my opinion.

DACA is an "executive branch memorandum".

It's a memo.

"Sometimes used interchangeably, an executive order is a more prestigious form of executive action that must cite the specific constitutional or statutory authority the president has to use it.

Unlike executive orders, memoranda are not required by law to be published in the Federal Register, but publication is necessary in order to have "general applicability and legal effect".

The Federal Register gives publication priority to executive orders and presidential proclamations over memoranda.

Memoranda can be amended or rescinded by executive orders or another memorandum, but executive orders take legal precedence and cannot be changed by a memorandum."

If the judge admitted that the President et al had the power to abolish the DACA program, then he no longer had any right/power to tell them how to do it.

This judge should be brought up on charges of unprofessional and unethical conduct, and anything else that fits the crime.

He did not help the Reamers with this decision. Now they have to start all over again giving the Govt more time to prepare it’s appeal.
