Hirono: Dems could keep SCOTUS seat vacant for two years

Sen. Mazie Hirono (D-Hawaii) said the Democrats could keep Supreme Court nominee Brett Kavanaugh's Supreme Court seat vacant for two years if need be should the nomination fail and should Democrats take the Senate in November.

Hirono said if a replacement for Kavanaugh needed to be found, President Trump should nominate a less conservative ideologue, or else be ready for Senate Democrats to keep the court seat vacant until after the 2020 presidential election if they win the chamber in November, according to an interview with Politico Magazine.

“I think we’ve had those kinds of vacancies before, and we certainly had over a one-year vacancy with Merrick Garland,” Hirono told Politico. “So the world does not come to an end because we don’t fill all of the nominees.”

Kavanaugh's nomination to the Supreme Court was roiled when California professor Christine Blasley Ford on Sunday publicly accused him of sexually assaulting her when the two were students at neighboring D.C.-area high schools in the 1980s. Kavanaugh has strongly denied the allegations.

The Hawaii senator said the new allegation had cast doubts about the nominee's testimony to the Senate two weeks ago.

During the hearing, Hirono asked Kavanaugh if he had ever sexually assaulted or harassed someone as a "legal adult." He responded that he had not.

“It somewhat stretches credulity, let’s put it that way,” Hirono told Politico.. “I think he didn’t want to lie about it, so one way you get through that is saying, ‘I don’t remember.’”

Hirono also called the allegations against Kavanaugh serious, even if was 17 years old at the time of the alleged incident.

“Seventeen is not exactly a baby, either," Hirono said. "These are serious allegations. She has a very credible story. I believe her. And now we have to do more than say, ‘Well, look at the timing!’ and ‘Well, it’s all politically motivated!’"

"This has to be taken seriously," she said.

Kavanaugh and his accuser are set to testify publicly on Monday.

Hey, Senator Hirohito:

If the Democrats win control of the Senate in November, don't you think Mitch McConnell might put the Senate in recess in December so the vacant seat can be filled with a recess appointment that would last for those entire two years?

Grassley needs be told by Mitch, get this through or I will adjourn the senate and let him make a recess appointment. We are not going to have another charade like Thomas or Bork.

I think a recess appointment would be good till 2020??

A recess appointment would last until the end of the next term of Congress — which would be December 31st, 2019 (I think).

Repeal the 17th. Amendment. The nation cannot continually be held hostage by our 100 biggest egomaniacs.


Repealing the 17th would return Senate elections to the State Legislatures as the Founders wisely intended. That said, you’d still have 100 egomaniacs. The Senate is the one part of the Federal government that can’t be abolished.

Senate Republicans and Never Trumpers seem quite happy with the prospect.

Where are you pulling that from?

Most Senate Republicans are voting for Kavanaugh and even Never Trumpers at National Review or the Weekly Standard don't want the place on the court going to a Democrat.

Her perjury, if she is really going to commit perjury, would be a serious offense. A 17 year old boy trying (and failing) to get to second base under ambiguous social circumstances?

The rats look stupid bringing up something that supposedly happened 36 years ago when he was in high school. Where was this slag for all these years? In two years we could be seeing the final stages of the Impeachment trial for President Pence.

I have seen the “outline” floated on the blue blogosphere. Trump in 19, Pence by the end of 20.

The only way we get any USSC picks through is a solid majority in both Houses of Congress.

Read the reports on the behind the scenes negotiations going on yesterday. Both on the hill and Breitbart. Look at the threads from yesterday. Besides, none of them were out there defending Kavanagh, other than Hatch. President Trump was the only one to really come out and say he was still 100% behind Kavanagh.

Suppose they vote down Kavanaugh, win the Senate and reject any nominees that Trump puts forth for two years. The court is then 4-4 for their pet issue. But what if during this time RBG dies? There goes the balance. Then you have seven members of the court and no way for the Democrats to redress the imbalance unless Trump nominates a liberal. They could easily set it up so Roe vs. Wade is overturned.

Everyone wants to wait for the midterms, to see which way the wind is blowing. The alternative to Republican is not Bolshekrat.
