The law might not have been but the judge seems to think it was unconstitional with him citing the commerce clause. Perhaps the judge was muddle headed and got it wrong or the MSM reports bungled the story details for their own perverse reasons.

“Last Tuesday, US District Judge Bernard Friedman dismissed conspiracy and mutilation charges against each of the eight defendants, ruling that the 1996 federal law banning female genital mutilation was unconstitutional because Congress has no power to enforce such a law. Because the controversial procedure is not technically a commercial activity, reasoned the judge, it does not fall under the Commerce Clause.” From the article.

I know because Congress has no power to enforce such a law was what I used in my original post.

The constitution does not address drugs, but the government still made them illegal its usage for recreational purposes. States that have legalized it still prohibit transporting it out of state.

There are times when my fellow Freepers are dumber than a box of Democrats after an all night meth party. As I have explained on other threads, the the Reagan appointed judge made the right decision under the Constitution, even if the result is unpopular:

The takeaway from most of the posts on this thread is that Freepers despise activist judges unless the judicial activism supports the conservative view, in which case judicial activism is ok. Idiots.

Not all males undergo circumcision, and for those that do, there are at least some health benefits that can be pointed to.

Not so for FGM. There are no health benefits at all.
