FULL TITLE: Justice Thomas Blasts Supreme Court for Sidestepping Planned Parenthood: “Quit Abdicating Our Judicial Duty”

U.S. Supreme Court Justice Clarence Thomas criticized his fellow justices Monday for refusing to do their job when they rejected a case about state efforts to defund the abortion giant Planned Parenthood.

On Monday, six of the nine justices refused to take two cases out of Kansas and Louisiana where lower courts refused to allow the states to defund the nation’s biggest abortion business.

Both states, and several others, moved to revoke taxpayer funding of Planned Parenthood after videos exposed the abortion giant allegedly selling the body parts of aborted babies. Planned Parenthood sued the states, and the 10th Circuit Court of Appeals ruled that Kansas cannot defund Planned Parenthood, despite an investigation by the U.S. Department of Justice into its aborted baby body parts trade.

Then, the 8th Circuit Court of Appeals upheld a similar effort by Arkansas to defund the abortion chain in 2017. Because of the circuit split, pro-life groups thought Supreme Court would take up the case.

Thomas said the court made a “mess” of the matter, and blamed the other justices for not wanting to touch a case involving the abortion giant Planned Parenthood.

“What explains the court’s refusal to do its job here? I suspect it has something to do with the fact that some respondents in these cases are named ‘Planned Parenthood,’” Thomas wrote in his dissenting opinion.

Justices Samuel Alito and Neil Gorsuch joined Thomas, but Chief Justice John Roberts and Justice Brett Kavanaugh joined the four liberal justices in refusing to hear the case.

Thomas said he was particularly troubled by the majority decision, because the case has nothing to do with abortion. Instead, it is about Medicaid and patients’ rights.

I have to agree with Roberts and Kavanaugh on not hearing this one. Neither Kansas nor Louisiana went to the trouble to show where funds for “low income women’s health” went. If it could be PROVEN that these funds were being used for abortions - and that’s pretty much all that PP does - then I’d’ve said go for it with this case but without actual documentation of how they lie and skirt the law I don’t see how the SCOTUS could rule it was unconstitutional. They wouldn’t even be able to prove what they were ruling on.

Thomas would only say this if he is genuinely disgusted with Kavanaugh and Roberts. Is there any rational reason Trump could not have come up with a rabid pitbull that we all want so much to be in our corner? Instead it appears that we got another Bambi.

The brightest Constitutional Legal Mind on the Bench.

When I saw this topic on another Thread it looked like the Case was Voted down by the SCOTUS because PP Funding was a Federal Law that the States had to follow and could only be repealed by the United States Congress.

This version casts a different light on what really happened.

Of course I understand that the Federal Government cannot directly fund Abortion, but the monies represented here are Fungible. At least that’s how they get around the issue.

I'm sorry I wasted any time defending Kavanaugh. It seems that he and Roberts both want to be the new swing justice.

I have an opinion on egotistical swing justices which I will refrain from expressing here lest I be banned.

If there is any bright side at all, it is the jack@$$ party shot so much of their capital on Kavanaugh that when Ruth Bader Ginsberg is called to meet her maker, Trump can nominate a real conservative rather than just another moderate squish.

I think Thomas spoke out because of Kavanaugh. I’d think Thomas had higher hopes for the new Justice.. and the big disappointment. Just letting him know this was not the time to side with the less branch of the 9.

How did funding of PP become a federal issue? Did the states delegate funding yo the feds? If not, it would still be a state call, right? Isn’t that in the Constitution? 10th amendment or something?

Justice Thomas seems to have been changing his temperament a bit lately. I think maybe the Kavanaugh mob attack brought back some memories and pissed him off.
