The Court's tradition is for the Chief Justice to survey the other justices. If the sentiment for retirement of the old or ailing member is strong enough, the Court's newest Justice is delegated to meet with that member and convey the view that retirement should be seriously considered. Usually, retirement ensues without resistance.

For example, Justice Oliver Wendell Holmes was so far gone due to age that he had trouble staying awake and frequented Washington's red light district to watch the burlesque shows with mouth agape. When tabloids began to report this, the Court finally acted. Asked to retire, Holmes immediately agreed and expressed surprise that his colleagues had waited to long!

Will RBG yield to a gentle approach? As her allies can be stirred to point out in private, if she can no longer do the job in full, she can be humiliated by leaking the details of her decline and disability, which then become a basis for threatening impeachment based on non-performance of duty.

If RBG drops dead anytime soon, expect the democrats in the house to immediately start impeachment proceedings - with or without any evidence - in order to claim that Trump doesn’t have the right to appoint a replacement while the impeachment progress plays out.

Ginsburg missing Supreme Court arguments for 1st time

WASHINGTON (AP) — The Supreme Court says Justice Ruth Bader Ginsburg is missing arguments for the first time in more than 25 years as she recuperates from cancer surgery last month.
Court spokeswoman Kathy Arberg said Monday the 85-year-old Ginsburg is continuing to recuperate and work from home after doctors removed two cancerous growths from her left lung odn Dec. 21.
Ginsburg was discharged from a New York hospital on Dec. 25.

I think the implication is that she herself is not contributing to the oral arguments. I believe she is listening intently to the entire matters and can put forth her opinion.....making it still....a 9 member court.
