Trump administration’s citizenship question on 2020 census blocked by federal judge

Political scientists predicted in court testimony that California would lose billions in federal funds plus at least one and possibly as many as three seats in the House — and the same number of electoral votes — if the citizenship question were to be used next year.

Are illegals supposed to, by law, be counted in teh Census?

Included in the total pop counts to allocate House Districts among the Sates?

Used for drawing State Congressional District Boundaries?

Obama did so much damage, it’s hard to comprehend. That SOB really did fundamentally transform America, and not in a good way.

Judges like this should be swinging at the end of a rope.

Yep. We need to put a stop to it. We have another year or so, even if they have to re-print the forms to get it right. Make it go right up to the Supreme Court.

It is worth it to do it.

IMO, only citizens should be counted. Not green card holders, H-1B’s or other legal aliens. It’s incomprehensible why citizens in areas swarming with non-citizens should get a bigger say in the House or the Electoral College.

The Constitution doesn't distinguish, so yes.

"Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed."

Obongo was a horrible, despicable person and if the truth be told likely the worst, self-serving anti-American president in our history.

Our republic may well not survive the carnage done by this traitor to all God loving patriots.

U.S. District Judge Richard Seeborg is just another Barack Obama stooge. Barack Obama had the intent of tearing down the structure of this country and appointed judges with the idea of doing so. This should go to the Supreme Court right away.

Ahead of court ruling, Census Bureau seeks citizenship data

As the U.S. Supreme Court weighs whether the Trump administration can ask people if they are citizens on the 2020 Census, the Census Bureau is quietly seeking comprehensive information about the legal status of millions of immigrants.

Under a proposed plan, the Department of Homeland Security would provide the Census Bureau with a broad swath of personal data about noncitizens, including their immigration status, The Associated Press has learned. A pending agreement between the agencies has been in the works since at least January, the same month a federal judge in New York blocked the administration from adding the citizenship question to the 10-year survey.

On Wednesday, a federal judge in California also declared that adding the citizenship question to the Census was unconstitutional, saying the move “threatens the very foundation of our democratic system.”

Yes, and that points out a huge flaw in our judicial system.

A decision by a federal district court judge that something is not unconstitutional does not create an order that binds the parties going forward. It results in the dismissal of that particular claim by that particular plaintiff against the defendant government, but that's it. It is a precedent, but it is not binding on other district court judges. It's only considered "persuasive", not "controlling".

In contrast, if a single district judge does find something to be unconstitutional, they can issue an order against the defendant government that binds the government moving forward. In other words, you can have 20 district court judges say "that's constitutional", but if even one says it is not, that's all they need.
