Well then we can just wait around until congress votes for the money to pay for that military to “secure the border”.
Or did you forget how that stuff gets paid for?
Hell we have troops fighting conflicts in which NO DECLARATION OF WAR WAS MADE.

If it’s “a bogus law”, then SCOTUS is wrong - they’ve upheld it, and the principle that the President’s power is at its fullest when he acts within powers specifically listed in the Constitution, or Congress specifically delegating power to him. Youngstown Sheet & Tube v. Sawyer
And Congress passed it - so they’re bogus as well. Blame them.

The Republican party is guilty as Hell of letting Obama get away with the pen and phone routine. Rand Paul, not so much.

I think the Congress can lower the President’s authority whenever they can find the votes, as it stands, the purpose of giving the executive this authority is for situations that require action that is needed faster than Congress can reasonably act. Such as when we are struck without warning.
Congress has shown that for one reason or another, they are unable to act and I would say that makes this the type of emergency that Congress had in mind when they passed the law.
And don’t forget the this is money that Congress has in fact appropriated, so the President is not usurping congressional power of the purse, again — I believe the court will find this entirely within the pages of the constitution.
The emergency act may be a bogus law, but it a law. Take it to the Supreme Court and get it overthrown. We have a crises on the border, the Congress won’t give the money necessary to protect, the President has every right to get the money to do so.
