Judge Blocks Trump Admin Rule That Makes It Easier To Deny Green Cards To Poor Immigrants
The Daily Caller ^ | 10/11/19 | Jason Hopkins

A federal judge blocked a Trump administration rule just days before it was due to go into effect and make it harder for low-income migrants to obtain green cards, dealing a serious blow to the president’s immigration agenda.

New York federal Judge George Daniels on Friday issued a preliminary injunction against the Trump administration’s “public charge” rule, which takes into account a foreign national’s use of government benefits when they apply to live in the U.S. on a more permanent standing.

Daniels — who was appointed to the U.S. District Court for the Southern District of New York by President Bill Clinton — ruled that the White House likely overstepped its authority when it moved to expand the public charge guidelines.

“In short, defendants do not articulate why they are changing the public charge definition, why this new definition is needed now, or why the definition set forth in the rule — which has absolutely no support in the history of U.S. immigration law — is reasonable,” Daniels wrote in a 24-page order.

Activist judges should be disbarred.

Only judges appointed by President Trump should be allowed to rule on cases on Trump policies.

That’s what the people voted for.

We voted for Trump policy and Trump judges.

Just pray Trump can remake the judiciary prior to his exit. We all knew Clinton left us disasters with his judicial appointments.

...which has absolutely no support in the history of U.S. immigration law...

BS It doesn’t! If an immigrant did not have a US sponsor or a prospective means of support when they arrived, they were not allowed in. Going on the public dole was NOT acceptable. That IS historic. This so-called judge doesn’t know his US history.

Um, Trump did not remake any rules. He is enforcing what is already on the books.

It is a hard enough sell to convince us that we must support vast numbers of Americans living in perpetual poverty; it is nearly impossible to convince us that we must import millions of third worlders and also pay to subsidize their perpetual poverty. This is why the activist judge ruled this way. If we wanted exponentially growing “public assistance” rolls, Trump would never have issued the executive order to enforce the law.

There has been a judicial assault against the president this week. All by liberal judges.

So much for separation of powers.

Of john roberts, nothing is heard.

Imo, the petty princeling is encouraging these actions by activists-against-President Trump judges.

“Only judges appointed by President Trump should be allowed to rule on cases on Trump policies.”

Any challenges to the President’s executive orders or decisions should originate in the US Supreme Court, not lower courts.

**************

It doesn’t do much good if one judge in NY or Hawaii decides to block his policies. The way things are now, any liberal judge in any state can stop the president. That won’t change no matter how many judges Trump appoints.

I don’t remember one judge ever stopping any Obama executive orders and policy. It’s so disgusting how unbalance our system is.

But have any new judges in the last few years under Trump have made any difference?

Absolutely.

With the President selecting a three judge panel to make the decision.

Actually, that explains the emphasis on circuit court judges. A ruling like this doesn't have to be appealed to the Supremes to be overturned.

I would think that by now Trump would have an appeal ready to go the moment some “judge” blocks his EO’s, rules, etc.

Perhaps but I don’t see any lessening of blocking presidential actions and policies by existing liberal judges.

The USSC should get involved but I have no confidence that they ever will.

Its no wonder faith in our government is being systematically destroyed.

I assume/hope Trump is doing likewise.
