Levin: Pelosi’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act...

Nancy Pelosi was apparently advised by leftwing Harvard law professor Lawrence Tribe to delay sending the impeachment to the Senate. So she’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act.

Here’s what Mitch McConnell and the Senate Republicans must do in response: The Senate has the sole power under the Constitution to adjudicate an impeachment. Therefore, Pelosi is attempting to obstruct the Senate’s power to act on its constitutional authority. McConnell should immediately put an end to this and declare the impeachment null and void as the speaker has failed to complete the impeachment process by timely sending it to the Senate for adjudication. McConnell has no less authority to unilaterally make such a decision than Pelosi does to withhold the administrative notification of an impeachment to the Senate either indefinitely or with conditions. Her effort to cripple the presidency and blackmail the Senate must be defeated.

Levin must not fall into Pelosi’s trap.

Start the trial absent the articles. Bring on the witnesses. Call Pelosi herself.

She won’t show but it will draw attention to her scheme.

At this rate they’ll get Trump elected in 2028.

If this is her chosen course of action, it no longer is an Impeachment.

It becomes a Super Censure.

I am reminded of something I read years ago HISTORY IS MESSY.

Like it or not we are witnessing history in the making.

Isn’t all this sending the articles over in a cherry box stuff just for show? I don’t think it is the Constitution,so Mitch should be able to start the Senate trial without the papers in a box things.

So shouldn’t President Trump appealed to the Supreme Court to nullify this “impeachment” on the grounds that it is unconstitutional because no crime, misdemeanor, bribery, or treason was committed? What would be the outcome?

According to the Democrats, nothing they do is unconstitutional. Ever.

However, if a Republican even breathes they have violated every article of the Constitution, present day and future

Yup. Read some history of the Lincoln or Jackson administrations and you'll see crap like this was going on every day.

Supreme Court will say this is a political question and a separation of powers issue and they have absolutely no constitutional authority to get involved.

This will be a disaster for the Democrats. I said a flip of 30 seats, I say it’s 50+ now in the House and a couple in the Senate. Trump will get reelected and then it’s really time to stick it to the Dems and finish them off, figuratively starve their constituencies into dust. I mean like cutting Federal agencies, block grants to states for union held work, clamp down even more on immigration, food stamps, welfare, etc. The urban populace(the parasite class and their overlords) have declared war on the rest of us. Ramp up investigations and start frog marching Democrats who are guilty of crimes out. Like arresting Pelosi, Schiff and the other coup leaders for their crimes. This is the definition of Pyrrhic victory if I ever saw one.

Absent the indictment, the articles formally presented, there is no need or basis for a trial

Something like that. They can point to the articles passed and say, “See! He was impeached! Orange man truly bad!.” But if the articles never get to the Senate then the Dem base might go nuts waiting for the delivery. Then again, the Demcrats could say, as a campaigning slogan, that the House passed two articles of impeachment AND THE REPUBLICAN SENATE NEVER TOOK ANY ACTION ON THEM, SO REPUBLICANS ARE BAD! There are plenty of other scenarios to consider.

I guess this is why I’m not a big Levin fan: he always correctly assesses what the enemy is doing, but he never gets around to innovative legal RESPONSES.

“Cocaine” Mitch is on the clock. Don’t hold your breath waiting for action from the do-nothing GOP Senate, though.
