The fight to get citizenship for descendants of German Jews

A British lawyer is accusing the German government of violating the country's constitution by refusing to restore the citizenship of thousands of people descended from victims of the Nazis. He argues that the law began to be misapplied under the lingering influence of former Nazis in the 1950s and 60s, and that it's still being misapplied today.

James Strauss has lived all his life in New York but in the 1930s his family ran an inn and butcher's business in the town of Gunzenhausen, south of Nuremberg. It was here that an event known as the Bloody Palm Sunday pogrom took place in March 1934, with the inn at its epicentre. As Nazis rioted in the town, two Jews were murdered and Julius Strauss, James's father, was beaten unconscious and locked up in the town's jail.

The pogrom is recognised by historians as one of the worst anti-Semitic incidents in Germany prior to the Kristallnacht attacks in November 1938.

The ringleader, Kurt Baer, a member of a Nazi paramilitary force known as the SA, was tried and jailed - but soon released by a Nazi-sympathising judge.

He then returned to the inn to take revenge, shooting and seriously wounding the 27-year-old Julius and murdering his father Simon. (Baer was later sentenced to life imprisonment, but pardoned after four years.)

As soon as he was able to, Julius fled Germany in fear of his life and settled in New York, where he met and married another German Jewish refugee. But he never fully recovered from the attack as the lead bullets could not be removed from his body, and he died as a result of his injuries in 1956, on his son James's ninth birthday.

Almost 60 years later, in 2015, James Strauss decided to make a trip to Gunzenhausen.

Article 116 of Germany's post-war constitution says descendants of people deprived of their citizenship during the Nazi era "shall on application have their citizenship restored", but the German authorities are refusing the descendants of people like Julius Strauss on the grounds that they left "voluntarily".

So, the argument is, "You should have stayed behind and gotten murdered. Then we would gladly restore citizenship.

This guy already survived one pogram in the early years of Nazi German. I'm not really sure how voluntary his flight was.

Is anyone surprised by this?

Also, I suspect a fiscal aspect as they would be more Germans eligible for German retirement benefits.

Not sure what the freeloading Muz get regards retirement under the German system.

2/3 of German Jews survived, because many left Europe, starting in 1933. Over 300,000.

2/3 of German Jews survived, because many left Europe, starting in 1933. Over 300,000.

But most of them "voluntarily" gave up their citizenship. I am guess many who were deprived of their citizenship were not allowed to leave.

Jews were sleepwalking from 1800-1945 thinking the majority of Christian Europe would FINALLY accept them as fellow Germans (or citizens of all other European nations) as part of the “Emancipation”.
Jew-hatred was rampant for 2000 years but in the 18th, 19th and early 20th centuries was also very strong.
Hitler’s base for annihilation was already set in place before 1933.
Ze’ev Jabotinsky (amongst others) as late as the late 1930’s of the coming Holocaust. Many stayed in place thinking there would be a sort of WWI Chivalric civility in terms of how POWs were treated or those under foreign occupation.
They missed all the clues, all the signs, all the violence, all the opportunities to run away but who could believe what was about to happen?

The “convert or die” option had always previously been available. Unfortunately, Germans not foreclosed the convert option in Germany itself - they extended it to every square foot of Europe they conquered. That was simply unheard of and unprecedented in anything but the aftermath of a bloody battle where the attackers slaughtered the besieged after suffering horrendous casualties. To do this in the cold light of day placed Germany beyond the pale.

They made the same arguments regarding money and personal property that was “sold” to Germany for pennies.

The only thing that has changed in Germany is they lost.

Sorry if I was not clear. Ze’ev Jabotinsky, Revisionist Zionist and very right wing (called a “Fascist” by Israel’s (then called the “Yishuv”) Lefty Communists) in Jews leaving the Lands outside of pre-State Israel and moving there to establish a state even against British Mandate rule.
He traveled to Poland, (he himself was from Odessa, Russia) in the years leading up to WWII. He told them to get out ASAP. They told him he was extremist and exaggerating.

His followers created the LEHI and STERN “gangs” that attacked the British in Palestine from 1946-48.

The most notable follower of Jabotinsky was PM Menachem Begin.

It's hard for me to imagine why a descendant would want German citizenship, unless there are legal or inheritance issues the article doesn't mention.

It’s mainly for Israelis who desire an EU passport and don’t want harassment like the time I was sat in a closed room for 22 hours by the Muslim customs agent in Gatwick for the crime of traveling on an Israeli passport.

The best Holocaust film out there is a Hungarian film from a few years back (2005) called, “Fateless”. It puts “Schindler’s List” towards the bottom of film greats that depict the Nazi savagery of WWII. Worth searching for.
