Posted on 05/23/2020 4:36:07 AM PDT by cotton1706

This will be a weekly post.

Count is now 194 judges confirmed.

141 District Court judges

51 Circuit Court judges

2 Supreme Court justices

McConnell has scheduled cloture on several more for next week.

This week Cory Wilson (5th Circuit nominee) had a hearing in the Senate Judiciary Committee.

Justin Walker (DC Circuit nominee) is currently awaiting a vote on the floor.

When Walker and Wilson are confirmed, Trump will have 53 Circuit judges in less than four years. Obama had 55 in EIGHT years!

Sounds like the Grennel appointment stopped all judge approvals and subsequent Ratcliffe approval (to get Grennel outta there) opened them up again. Turtle says; Rs are exposed too, with this Grennel wildcard. No judges while he’s exposing us with declassifies

All three judges got substantial Democrat support...

Scott Rash - 23 Democrat votes

Anna M. Manasco - 22 Democrat votes

John F. Heil III - 26 Democrat votes

My perspective...

Any time more than 6 Democrat Senators from toss up states vote for a GOP nominee, it means the judge will NOT be a reliable Conservative.

Of Note Future Flips & Ties
1. When the 10 open seats in Central California are filled the court will flip to Republican nominated majority (8 waiting confirmation, 2 without nominees). There are also 6 justices born in the 1940’s - 5R 1D.
2. The two seats open in CA-East when filled will tie the court (1 awaiting confirmation, 1 w/o nominee).
3. CA-South has 5 open seats w/ nominees. When those seats are filled the court will flip from 4R 4D to 9R 4D
4. Filling the open seat in CO will flip the court from tied to R4 D3 (there is no nominee)
9. Filling the seat in MN will convert the court from a tie to 4R 3D. (no nominee)
11. NJ is big league! Present 4R7D. After filling the 6 open seats the court will flip to10R 7D. No nominees at present.
12. NY-East after filling the 3 open seats (2 named nominees) the court will flip to 9R 6D. There is a potential to flip NY-North, filling the open seat the court would be 2R3D and there is a seated D justice born in 1937. NY-S filling open 3 seats 9R 19D (not much motion expected here)
15. SC filling the open seat (no nominee) will tie the court 5R 5D
16. TN-East filling the open seat will change the court from a tie to 3R 2D
18. Virginia-East with the filling of the two open seats (1 with a nominee, 1 no nominee) this court will flip. Present composition 4R 5D, after filling open seats 6R 5D. There are three justices born in the 40’s 2 Clinton 1 Bush.
20. WI –East. This is another opportunity for a flip. 1R 2D now, filling the two open seats (1 nominee in place) would change the court to 3R 2D. There are two elderly justices seated, born in 1939 Clinton & 1942 Reagan.
7. Filling the two open seats in IL -South would tie that court 2R2D (there are two nominees in place).
The other two districts in Illinois are hopeless. Filling the two open seats in IL-North (nominees in place) would bring the court to 9R13D
19. WA -West. Another big league opportunity. Only 2 justices in place out of 7 seats, both sitting judges appointed by Bush (born 1950 & 1951). There are 5 open seats none with nominees. These seats would be a shame to leave open at the end of POTUS 1st term.
17. TX-S This court doesn’t look much like Texas. Present 10R 8D Filling the open seat (on the docket for cloture Tuesday) will improve the margin. One Reagan appointed judge born 1941.
5. FL-Middle. Filling this opening (nominee up for Confirmation Tue) will move the court to 9R 6D
6. FL-South filling the open seat (nominee just named) will move the court to 11R 7D. There are two Bush nominees born in the 40’s
8. MA. Filling the two open seats (no nominees) would yield a composition of 5R 8D. There are 4 justices born in the 40’s 2R 2D so there is a potential to shift that court in the second term.
10. Filling the two openings in NV will change the court from 0R5D to 2R 5D (one nominee has been named)
14. PA-East filling the open seat (no nominee) 13R 9D (4 R appointed judges were born in the 40’s)

Bottom line all of the activity is in district court judges. The quality and leaning of them is inconclusive due to the honoring of the blue slip legacy where both D senators in those unfortunate states can block non-rat judges.

Why the reluctance of 80 yr old ckt judges to go to senior status when both old and new are R. Unbelievably arrogant and selfish. Typical govt garbage.

Glad to hear it has started again after so many wasted months...
However, my unabated paranoia (as a result of having been aware during every communist administration since & including FDR) keeps me very suspicious when the vote tallies are that close...
How could nominees who meet "our" criteria for federal judgeship garner about 20 communist votes?
Just asking...

Would that my mind was logical enough for that course...
I worked from the listing of all of the district courts correlating with the Governmental listing of vacancies, future vacancies, the Senate list of nominees and the President’s list of nominations. It’s pretty ungainly.
Then when I had them done they were in order of Circuits ie District Courts in Circuit 1 with meaningful changes, followed by Circuit 2 etc.

But when I had that done I decided to organize in terms of courts flipped or tied and then meaningful changes in court composition. I moved them around and then I was tired & thought I’d reorder after Cotton had posted in the am. Always best to do things then & there...

You have given me something new to learn. Thank you.
I worked this up in word and cut & pasted with some trimming onto FR. Another time for a less involved analysis the ol etc could be very useful and will be fun to figure out.

See this post #30 for some Good Judgin' News:

It appears as though Chairman Xi's two Senatrixes, "Beijing Diane" Feinstain and "China Kammy" Harris, are in a CalifMexican standoff with Leader McConnell over the appointment of new Southern District of California judges.

FIVE open regular bench seats. FIVE.

I'll bet the natives on the SC Cali bench are getting restless for relief.

I'm also noticing a trend in my Circuit Court/District Court tables, where I include the age of the judges.

While there are some few older judges who cling to the bench like a dead cicada, well after their prime, most judges either take senior status at 66-67 years old, or rarely, retire outright.

The Lefty partisan creep-fossils appear to be holding out for a Gropin Joe Biden ascension.

The Usual Suspects [all three Nays on these judges]:

  1. Blumenthal (D-CT)
  2. Booker (D-NJ)
  3. Cantwell (D-WA)
  4. Gillibrand (D-NY)
  5. Harris (D-CA)
  6. Hirono (D-HI)
  7. Klobuchar (D-MN)
  8. Menendez (D-NJ)
  9. Merkley (D-OR)
  10. Murray (D-WA)
  11. Schatz (D-HI)
  12. Schumer (D-NY)
  13. Stabenow (D-MI)
  14. Van Hollen (D-MD)
  15. Warren (D-MA)
  16. Wyden (D-OR)

The other Nays on each judge come from varied sources, probably related to personal/regional issues related to the nominees.

Surprised not to see Sheldon Whitehouse's name on any of the lists.

I'm starting to see Leonard Leo's name in the Senate Judiciary Spanish Inquisition PDFs, along with the Federalist Society and the Heritage Foundation.

Questions on originalism and textualism, also.

!!!

The ChiComm Cartelfornia witches are under siege.

Even though the Senate is looking grim at this time, maybe the Obamagate pasting that is soon to come might salvage Leader McConnell's bailiwick.

If either of you want me to whip out a District Court table, just ask.

I've only got 3 more Circuit Court tables to finish [the Third, the Seventh and the Eighth], and then I'll put up a Circuit Court Master post where you can steal the html whenever you want to make a circuit court point.

I've started including the court jpg maps on the posts.

I use the 'view page source' option on the right-click context menu.

Ah yes but they will be waiting at the altar in their wedding dresses until 1/2025 at the earliest. After the election some of them will take senior status. Maybe even RBG will retire.
