New York State’s top prosecutor is threatening to sue President Trump if he follows through on his threat to deploy the United States military to put down domestic protests that were sparked by the police-involved killing of George Floyd.

‘The President of the United States is not a dictator, and President Trump does not and will not dominate New York state,’ Attorney General Letitia James said in a statement on Monday.

‘In fact, the president does not have the right to unilaterally deploy US military across American states.'

Good luck with that. Insurrection Act of 1807 is 100% legal and still in effect.

I doubt it’ll come to this, but one wonders what would happen if Trump dispatched U.S. Army or Marines to restore order to Manhattan and the State of New York rejected their presence. Would the State of New York attempt to eject them in some non-judicial manner? Fort Sumter II?

President Trump will not send U.S. troops anywhere against the wishes of that state’s governor. You can take that to the bank. There’s no upside to it.

Looking forward to the State of New York being declared in rebellion and a number of state officials *literally* being arrested and shipped to Gitmo.

He will if the Governor does not deal with the situation and put down the violence under the 1807 Insurrection Act. He can also put the state’s NG under his control as they are Federally funded DOD Military reserve units.

In fact, the president does not have the right to unilaterally deploy US military across American states.’

Oh yes he does. It's been done several times by previous presidents. :

The Insurrection Act

The Insurrection Act of 1807 is a United States federal law (10 U.S.C. §§ 251–255)[1] (until 2016, found at 10 US Code, Chapter 15, §§ 331–335, renumbered to 10 USC, Chapter 13, §§ 251–255) that governs the ability of the President of the United States to deploy military troops within the United States to put down lawlessness, insurrection, and rebellion. The general purpose is to limit presidential power, relying on state and local governments for initial response in the event of insurrection. Coupled with the Posse Comitatus Act, presidential powers for federal military law enforcement on U.S. soil and unincorporated territories are limited and delayed.

(1) The President may employ the armed forces, including the National Guard in Federal service, to–

(A) restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that–

(i) domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order; and

(ii) such violence results in a condition described in paragraph (2); or

(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).

(2) A condition described in this paragraph is a condition that–

(A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or

(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

Did this stupid attorney general do any legal research before making those statements? She does not have to do it herself...She could have asked her chief deputy attorney general to do the research...

She wants to sound “tough”...Whatever...
While NY State is in chaos, she cannot set aside her hatred of President...

If some federal judge stops the deployment...Whatever...President was just to be helpful...

This is from the link you posted (note the bold text):

The Insurrection Act is brief. It allows the president, at the request of a state government, to federalize the National Guard and to use the remainder of the Armed Forces to suppress an insurrection against that state's government.

You’ve actually made my point. The Insurrection Act was amended in 2007 to allow it to be invoked WITHOUT state approval, but that provision was eliminated after all 50 governors unanimously opposed it.

With what?
How many military divisions, tanks, F 22 Raptors and B2 bombers does Cuomo have?
