IOW we do not a Constution at all. Just an ever changing vague set of rules established by SCOTUS with occassional help from Congress.
Under irwin’s theory, SCOTUS could dissolve the States tomorrow and that would be perfectly OK.
Now you know why this is such foolish drivel.
New York Times published it...
That is all, no further explanation needed unless you believe them
What I asked of you was YOUR beliefs not post and ghost
You finally revealed yourself in your response using the NYT as authoritative and true
Nuff said
What kind of tripe is this?
Hey, I base my beliefs on the Bible and that was written a lot longer then two centuries ago. It’s still true for today.
Now I know she the right person for the job, God speed, Judge Barrett
Because today’s slaughter of nascent innocence is the epitome enlightenment...
GTH, Erwin, ya’ pathetic munt.
So family values, morals and love of God, country and constitution! Is so old!
The wisdom of the Founding Fathers vs the likes of Maxine Waters.
Anti Christian
(But youre an anti Semite if you call a spade a spade like Cherminsky over it)
The Constitution and Bill of Rights are the documents that determine our rights.
Even though the Dems ignore them all the time.
Seek is like hi jinx and johnhuang2 used to be
He likes to post...threads....Im not sure its nefarious
“What kind of tripe is this?”
The kind of tripe that is pushed to our innocent children.
[NYT Editorial/Erwin Chemerinsky] The same Congress that voted to ratify the 14th Amendment, which assures equal protection of the laws, also voted to segregate the District of Columbia public schools.
Congress does not ratify amendments. Congress proposes amendments. Amendments are ratified "by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof."
What was ratified was the language of the amendment as that language was understood at the time of ratification.
One of the beauties of the US constitution is that if it truly becomes outdated and improper, it can be changed. The procedure is quite simple: Two thirds of the states must approve any change. If the constitution were truly wrong, the change would be overwhelmingly approved. If NYT simply doesn’t like it, nothing would happen.
This situation is clear, the NYT simply doesn’t like it. Too bad for them.
“The Constitution and Bill of Rights are the documents that determine our rights.”
No, they recognize our rights, which are determined by our God-given natures.
“Do we really want our rights to be determined by the understandings of centuries ago?”
IOW, the Constitution is irrelevant, so smart guys like us get to make things up.
The “understandings of centuries ago” provide an orderly mechanism to modify the law of the land, using the Amendment process. That doesn’t work for the NYT because they’d have to persuade the American people, and the American people are not buying what they’re selling. So instead these thuggish elites want to shove things down our collective throats.
The Old Gray whore can be ransacked and burned for publishing such comments. The malicious abd out of control Slimes must burned to the ground.
However, the Constitution prevents attacking the malicious New York AntiAmerican trash
On the one hand, the leftists freak out because Barrett’s approach is to adhere to the original Constitutional meaning. She doesn’t embrace change. She doesn’t recognize any evolution of thoughts and ideas. She’s too set in stone.
On the other hand, the same leftists freak out because she might overturn some of their beloved precedents. She’s a loose cannon who doesn’t adhere to stare decisis. She might recognize that things have changed or thinking has evolved since a prior SCOTUS decision.
None of this has anything to do with Barrett or her qualifications or judicial temperament. It’s all about the leftists wanting leftist activist judges who will impose their political ideology on America.
You’re right but I interpreted the post as a legal argument.
