The U.S. Supreme Court on Wednesday will hear oral argument in Caniglia v. Strom, a case that could have sweeping consequences for policing, due process, and mental health, with the Biden Administration and attorneys general from nine states urging the High Court to uphold warrantless gun confiscation. But what would ultimately become a major Fourth Amendment case began with an elderly couple’s spat over a coffee mug.

I have ZERO faith in the Roberts court. Especially with the gun bill drum beat the Socialists have going on right now.

Yep, it’s a fool’s errand hoping for Constitutional law coming out of the Supreme Court.

We have reached banana republic corruption levels, it’s simply not sunk in with the Sheeple. Probably never will.

The Court decided to hear the case.

That means at least four justices think the case should be overturned, and they think they have the votes to do it.

It is primarily a Fourth Amendment case.

The "gun" part is whether the court will implicitly find their is a "gun" exception to the Fourth Amendment.

They have not done so, so far.

There was a similar case in Wisconsin, where the appellate ruling upheld the police.

This should be overturned by the Supreme Court.

“A rule that allows police to burst into your home without a warrant whenever they feel they are acting as ‘community caretakers’ is a threat to everyone’s security.”

why is he allowed to stay on the court at all.

If the Supreme Court says someone can seize anything without a warrant, the same would apply to seizing a Supreme Court justice.

I also have no faith that they will support the second amendment.

No court has done so since 1932.

So I will have to do what I have done when they have ruled against the constitution in the past and ignore the ruling.

This is a dangerous path but I have no other choice.

The lower courts also ruled that the officers were covered by qualified immunity in taking the guns.

I believe this is incorrect.

They performed a warrantless search and confiscated the guns by means of uttering a falsehood, namely that the husband had agreed to the removal of the guns.

A warrantless search and the taking of property by deception. That to me is theft.

One day, it might be one of us, “Deplorable Gun Owning Americans,” who is going to rescue your a$$ and your family’s from the leftist onslaught once the left decides that their, “Useful idiots,” have served their purpose and they make the decision to hunt you down for your burdensome decisions of the past.

No, but four is the minimum needed to vote to grant a writ of certiorari. (to hear the case)

They would seldom vote to hear a case they were not willing to overturn, and believe they could, in a politically charged issue.
