A houseless man was arrested and held in a state mental hospital for two years and eight months after being mistaken for the wrong man, according to the Hawai'i Innocence Project.
The advocacy group filed a lawsuit Monday night alleging Joshua Spriestersbach was wrongly arrested in 2017 while he was waiting for food outside of the Safe Haven shelter in Chinatown.
Ken Lawson, the co-founder of the Hawai'i Innocence Project, claimed the officer who booked Spriestersbach did not compare fingerprints when he mistook him for Thomas Castleberry, who was charged for several crimes in three different states.

If it took him 2 years to realize he wasn’t the right guy, maybe he belongs in a mental institution. Just put the right name on the door.

Yup. Daily schedule from Hawaii jail:

"Instead of taking 5 minutes to just get the photograph, or Google the real Castleberry, they would have found out that the real Thomas Castleberry's been locked up in Alaska since 2015. He's still in prison now," Lawson said. OOPS!...............................

The man protested from the start that he wasn’t the guy from Alaska and the bastard cops and prosecutors used that to justify putting him in a mental hospital and forcing medications into him he didn’t need. It was only when a psychiatrist intervened and demanded the cops positively identify the man that he was set free but only after the cops and prosecutors conspired to cover up the whole incident.

Back in the early 80's my best friend's brother (Vietnam Vet, U of Mich. grad) developed schizophrenia and was living alone on a beach in northern Michigan. My friend constantly tried to get him hospitalized by the District Court Judge who happened to be a long time friend of the family. The judge was unable to do anything until Skip was proven to be a threat to either himself or others.
It wasn't until late fall with winter setting in and Skip still on the beach in freezing temps that the judge finally issued an order for Skip to be hospitalized at the state mental hospital in Traverse City until his condition could be controlled with the proper medication,.
Unfortunately for Skip, he was placed in the ward for the criminally insane where he was almost beaten to death by another "patient"..........
