We can only speculate. It seems the dem leadership has bought into idealogy and can’t retreat now. I think they are idealists and true believers. They believe oil is a dinosaur and we must bite the bullet and change now. The problem is the technology is not ready to replace oil. However they think they are smarter than everyone else and will find a way.
We shall see how their base feels when gasoline increases another few dollars.

Yes. Since the federal government.I.E. the SCOTUS failed to defend the constitution the last election, per the equal protection clause, there is no longer a compact between the states.

$89.33 this morning at the same station for the same about of gas, I could have got for $36.34 on November 7, 2020.
Now this story and the story that the Biden misAdministration missed the deadline for the annual leases tells me, they are pretty confident going into November.
81 million votes may or may not be enough, so I am guessing at least 90 million Democrat votes this fall.
Nobody in DC has had to buy gas in decades.

It is a regulation and yes they can. Congress deliberately writes vague laws and then lets the enforcement agencies make the rest up as they go.

Yes it is called “rule making” authority or “administrative law.” All regulatory agencies have and use it without restraint...other than what the USSC did this week.

True, Rule Making is what Administrative agencies do.
However, the rulemaking must comport with the APA (Administrative Procedures Act). This is where notice and comment periods come about and the rulemaking process has to “stay canalized” to the purpose set forth in the enabling statute for the agency. If the bounds are overstepped by the agency, the rulemaking then becomes an “ultra vires” act, and the rule becomes an illegitimate law subject to being stricken down.
And Biden will wipe his ass with Abbott’s letter.
