Chief justice temporarily pauses end of Title 42 border restrictions

El Paso, Texas — Supreme Court Chief Justice John Roberts on Monday granted an 11th-hour request by more than a dozen Republican-controlled states to temporarily pause a lower court ruling that had ordered the end of a COVID-19 border restriction known as Title 42.

In a one-page order on Monday, Roberts agreed to place on hold a November ruling that declared Title 42 illegal, pending further action from the full court. Roberts gave the Biden administration until Tuesday evening to respond.

Can anyone elaborate on the legal/constitutional basis that Stevens was able to do this? It’s not that I disagree with Title 42, but what is the current health emergency? It was a weak method to implement immigration policy. I get the fact that Congress wouldn’t do anything and the Executive branch doesn’t enforce existing immigration laws.

As to 42...I'd say as long as they're recommending vaccinations, the policy should stay in place.

The logical basis is that non-US citizens must be vaccinated in order to enter the country. Therefore, if a non-US citizen crosses the border illegally, they can be rapidly deported unless/until they prove vaccination status.

It’s one more arrow in the quiver fighting illegal immigration.
