Judge Ignores Evidence of Official Misconduct, Rules Against Kari Lake in High Stakes Arizona Election Case

"And the defendants, their attorney said it in his closing statement. He said, we choose our rulers. Isn’t that telling?" Lake said.
Republican Kari Lake’s legal challenge against former Secretary of State and now Governor-Elect Katie Hobbs was thrown out on Saturday.
The court rejected Lake's claim that ballot printer and tabulation issues at a significant number of polling places on Election Day were the result of official misconduct that changed the results of the election.
In a decision Saturday, Maricopa County Superior Court Judge Peter Thompson found that the court did not find 'clear and convincing evidence' of the official misconduct that impacted the election. Lake will appeal the ruling, she said in a statement.
“The Court cannot accept speculation or conjecture in place of clear and convincing evidence,” Judge Thompson said.
Former Secretary of State and Governor-Elect Katie Hobbs did not testify about certifying her own election. Kari Lake's team withdrew their subpoena of Hobbs earlier in the week.
Kari Lake exuded confidence following the last day of the Arizona election trial on Friday that she had made her case: Maricopa County election officials and her rival gubernatorial candidate Katie Hobbs had acted with "malicious intent" to deprive her campaign and Arizona voters of a free, fair, and cleanly run election.

I looked at the evidence. I read the transcripts of witnesses.
They pointed out that there was a 1 inch discrepancy on ballots that prevented those from being machine tabulated.
This was true.
The elections people never denied it. But.
Those ballots were not excluded from the count. They were set aside and counted later. None of those voters were disenfranchised.
Pre election polls showed no overwhelming Kari Lake lead. There were polls showing she had a lead. There were polls showing her opponent had a lead. There is no shock in the outcome, and it has nothing to do with fraud.
What it came from the the McCain wing of the AZ party will not support MAGA candidates. They would rather have a Democrat. MAGA voters so far are not reciprocating, and this has to change.
Add to this effect the reality that California imports have changed the electorate in AZ and you have a formula for that state turning blue.
There is much less evidence of fraud in AZ than many other states. The polls did not say the outcome would be different than it was.

Keri didn’t even care enough to show up to testify. That’s all you need to know.

The problem this country has is the ruling elite, politicians, judges, FBI thugs and bureaucrats don’t fear the people they rule over. That needs to change.
To: MAGAthon
Why was an FBI agent from the Cyber division named Kori Lorick posing as Arizona’s Director of Elections for the 2022 midterms? She was not working at the FBI at that time. That was a previous job.

Why would Keri testify to what? There is no policing the elections anymore. Cheating has no consequences.

Whoever didn't see this coming completely underestimated the level of flat-out corruption that exists in our electoral system, judicial system, executive system and legislative system. If elections mattered, would they let us cast votes?
Nope.
Short of what's stated in my tagline below which I've had since Nov. 2000, there is NO CONSTITUTIONAL PROCESS to fix what Congress, the Courts and the Legislatures have all done to rig this country against each and every one of us.

Like any of this has any significance in the cosmic sense? Christ himself lived through revolutionary times. Have you ever watched Ben Hur? Not going to speak for God but pretty sure he doesn’t give a crap about this matter. If so, why is this different than when the barbarism of the 20th century took root. Or the barbarism of every other century?
America is just another country like Rome was. Like Russia is. Like Germany is. Like Spain. Portugal. Turkey. The world. Through all of history. If He chooses to end it now it won’t be because the USA’s elections have been corrupted. That’s funny right there.

Why would you sue
and then say heck, I’m not showing up for court? Seems bazaar.

Yes, the judge demanded that Lake identify a specific person who changed the setting on the ballot printers, and of course, such a demand was near impossible to meet. He also demanded that Lake prove that enough of her voters were swallowed up in the election day chaos to change the outcome, another near-impossible task. He threw out the other 9 other charges Lake made. My guess is that he wanted to be able to say that Lake had her day in court, but not be put in a position to declare that the election was fraudulent or needed to be done over. I’m sure pressure was brought to bear and he eagerly went along with it.

Yes, Judge Peter A Thompson has ruled from the Maricopa Superior Court of Arizona, that success for Mrs. Kari Lake’s lawsuit was contingent upon her being able to prove malicious intent on behalf of the country election officials. [Read 10-page Ruling HERE]
The Maricopa County officials have denied malicious intent and are afforded great benefit of doubt; after all, the election result was duly certified.
Therefore, absent direct evidence of corrupt intent by the election officials, which would require them to make admissions in court, any certified outcome is considered valid.
Additionally, yes there were multiple documented problems with ballots, tabulators and chain-of-custody violations; and yes, there were multiple simultaneous failures which would have impeded accurate voting by the residents of Arizona; however, the Lake campaign could not quantify to a demonstrable certainty, the exact number of votes that were impacted by the simultaneous collapse of voting systems, processes and ballot control standards.
Absent Mrs. Lakes’ ability to scientifically and empirically quantify the exact number of votes impacted, there is no basis for a judgement in favor of the plaintiff.
Lastly, the defendant has requested that Mrs. Lake be punished by the court for attempting to question the certification of the election as validated by her opponent, the court will consider what punishment to impose and proclaim the sanctions after Monday, December 26, 2022.
“Plaintiff has no free-standing right to challenge election results based upon what Plaintiff believes – rightly or wrongly – went awry on Election Day. She must, as a matter of law, prove a ground that the legislature has provided as a basis for challenging an election. …
“[O]ne who would contest an election assumes the burden of showing that his case falls within the terms of the statute providing for election contests.” … “It was Plaintiff’s burden to establish each element by clear and convincing evidence. If Plaintiff herself failed to sustain her burden of proof, the matter is decided.” …
“As far as evidence of misconduct is concerned, the Court finds nothing to substantiate Plaintiff’s claim of intentional misconduct.” … “Plaintiff’s own witness testified before this Court that the BOD printer failures were largely the result of unforeseen mechanical failure.” …
“It bears mentioning that election workers themselves were attested to by both Plaintiff’s witnesses and the Defendants’ witnesses as being dedicated to performing their role with integrity. Not perfectly, as no system on this earth is perfect, but more than sufficient to comply with the law and conduct a valid election.” (LINK)
The court will now determine what punishment to apply to Mrs Kari Lake.

Stevie Wonder could have seen that coming. As evidenced by the election of 2020 the American voter will not tolerate an honest person leading them. They prefer being ruled by tyrants as personified by the hench men/women/ freaks of nature that make up the Cabinet of Lying Joe Biden. The election of 2022 reinforced this. As the election of 2024 will underline the result[s] of the 2022 mid terms.
