I’ve seen the video...he shot the guy about a half dozen times. From what I saw one shot would have been justified...maybe even two. But it seemed to me that the guy went a bit overboard.
Knowing what you currently know, if you were on the grand jury would you indict?
Knowing what you currently know, if you were on the petit jury would you convict?
Why do you think that? Was it unfair? How many shots do you think are allowed? (Hint, the law has no such number)
“I’ve seen the video...he shot the guy about a half dozen times. From what I saw one shot would have been justified...maybe even two. But it seemed to me that the guy went a bit overboard.”
It is not the number of shots that is important. The shooter was not going to wait to see if the perp turned and started shooting him and others. He took out an immediate threat. He didn’t have to wait or count his shots.
Abuse of a corpse.
“From what I saw one shot would have been justified”
So shoot one time, see if they guy shoots back, then OK for shot number 2? Don’t be so naive, you shoot until you are 100% sure your life is not longer in danger. Every shot was justified, unfortunately in Houston with a Soros DA that last shot looks bad.
Next time someone sticks a gun in your face, how far overboard will you go or will you just smile and hand over your valuables?
You don’t stop shooting until the threat is down...period. You don’t know if the perp is on drugs and might keep coming.
>>But it seemed to me that the guy went a bit overboard.
But who cares? I certainly don’t - hopefully a jury won’t either.
The guy was probably DOA before the last shot, so maybe for that 9th shot he didn’t kill him, just shot a dead body.
>>From what I saw one shot would have been justified...maybe even two. But it seemed to me that the guy went a bit overboard.
If someone is worth shooting once, he’s worth shooting twice. And if he’s worth shooting twice, he’s worth emptying the whole magazine into. I know ammo is expensive, but putting a criminal down is not the time to be stingy with the bullets.
The guy was facing an armed robber who was implicitly threatening to shoot and kill innocent people. It is not unusual for this type of criminal to kill his victims after robbing them. It is common for firearms instructors to teach that when in self defense situation in fear of your life, keep shooting until the perp is down or you run out of ammo. It's amazing how many shots a bad guy can absorb and still shoot back and kill you.
Well, from where I sit, and based only on the video, IMHO,
shots 1-3 totally fine. No grand jury, even in Harris county.
shot 4, probably still fine, but I’d rather not have to defend it.
Shots 5-8, in Waller county, no grand jury, in Harris, for sure a grand jury for some degree of manslaughter
Shot 9: you’re going to get a grand jury in just about any Texas jurisdiction.
My 2 cents. The author of the piece is perhaps the nation’s preeminent authority on the legal use of self defense deadly force, and does a much better job explaining everything than I ever could.
I was trained to make sure the adversary is 100% incapacitated. If that means emptying a magazine into them, so be it.
The coup de gras was administered. The question is was the armed robber already dead when the last shot was fired?
Forensics can actually figure that out. If he was dead it’s moot.
Then what? You're just watching a video, you weren't there with your body charged with adrenaline while another potential victim was sitting at a table at the back left corner of the video.
What do you think he was thinking as the thug was advancing towards him with a gun?
You certainly wouldn't qualify as an expert witness since it's unlikely you ever experienced a life threatening event as that. And if you were there, I doubt you would have yelled at the samaritan to stop shooting after the first or second shot.........LOL!
My wife asked a police officer about what she should do if she had to use a gun on somebody who was attacking her. The police officer said empty the clip into them and make sure they’re dead. If they survive, there’s a good chance the peep is going to sue your ass into the ground...and win.
It’s easy to shoot “too many times” in that time stopping, panic driven, high adrenaline moment. 1 shot or 10 shots, makes no difference if it was justified unless the douchebag was trying to surrender. In this case, he didn’t have time before he was dead.
