Trump’s Maximum Sentence Could Be 136 Years, If Convicted

Former President Donald Trump could face up to 136 years if he is convicted on all 34 counts of falsification of a business record, if the judge decides — though the more likely maximum is probably four years, or less.

Under New York State law, the crime with which Trump is charged is a “Class E” felony, which carries a maximum sentence of four years:

§ 175.10 Falsifying business records in the first degree.

A person is guilty of falsifying business records in the first degree when he commits the crime of falsifying business records in the second degree, and when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof.

Braggs case against Trump says the hidden payment entries to Stormy were to illegally hide things in the 2016 election. The payment to Stormy was made in 2017! People are goofing on Bragg for not reading a calendar.

I was watching a lawyer on live (someone posted it on FR) and someone had messaged him saying that that SOL in NY was extended 288 days by what sounded like an executive order.

Supposedly it had nothing to do with Trump but was extended because of Covid. ?

Obama, biden, hillary, pelosi, schumer, and so many others would get 3000 years if this standard is used against them during their trial and subsequent convictions which are now a sure thing.

I thought he said Lawyer A (Cohen) paid her before the election. Then Trump paid Cohen in 2017.

What, exactly, is he actually charged with? 34 counts of a felony “FALSIFYING BUSINESS RECORDS IN THE FIRST DEGREE, in violation of Penal Law §175.10”.

This “crime” is defined as Falsifying Business Records in the Second Degree, with intent to defraud and intent to commit another crime and aid and conceal the commission thereof, made and caused a false entry in the business records of an enterprise.

You have to prove there was ANOTHER crime being committed to get a conviction on these indictments. Yet there is NO reference to ANY other crimes.

We need state & local prosecutors to charge all of them on crimes. I don’t care if they are real or not. Just charge them and make them defend against it. Show the country how this works.
