Former New York City Mayor Rudy Giuliani is on trial in Washington, D.C., this week for defaming Georgia election workers Ruby Freeman and Wandrea "Shaye" Moss in the aftermath of the 2020 election. Giuliani, acting on behalf of former President Donald Trump, accused the mother and daughter of committing election fraud while the two were counting ballots on Election Day in Georgia's Fulton County.

U.S. District Judge Beryl Howell in August awarded a default judgment to the two women, leaving this week's trial to determine the full scope of the damages and any penalties Giuliani will have to pay. Freeman and Moss are seeking between $15.5 million and $43 million.

was Rudy able to use as his defense ALL or ANY of the evidence that these women are scoundrels and their video of them pulling the ballots out after the place was emptied of witnesses?

I see the “jury” and “judge” raising it to at least 24 BILLION. 24 MILLION is chump change and it is disrespecting these two chumps.

Or the mother/daughter that apparently pulled boxes of ballots from under the tables once the room clear because of an apparent water leak?

Or $24 trillion?

A request for damages far in excess of any conceivable loss. I would be willing to have a Democrat defame me in return for a judgment = 1% of what they are asking for.

I’m no lawyer. But it would seem to me that what Giuliani said (rightly or wrongly) falls under the protection of free speech.

The 1A does not protect you against repercussions for defaming a private individual. But it does protect you against repercussions for defaming a government official. And these two poll workers were acting in a governmental capacity.

So, for example, I cannot say without evidence that my neighbor is a Chinese agent bent on destroying America. That’s inviting a lawsuit.

But I can say without evidence that Biden is a Chinese agent bent on destroying America.

Again, I’m no lawyer. If I’m wrong, hopefully someone will correct me.

He chose not to.

That’s why there was a summary judgment against him and the jury is now deliberating compensation, if any.

Even when there is documented video evidence showing those women are totally guilty.

Do the plaintiffs get to return to Giuliani any unspent award money? I can see both of them feasting with their huge pile of cash on Wagyu steak, Wagyu burgers, piles of french fries and, of course, lobster—every night. They might not last six months. It’s the fairness of this matter.

U.S. District Judge Beryl Howell Is a Jewish Democrat (like Merrick Garland, Judge Arthur Engoron etc) who presided over the grand juries investigating Trump et al. She also ordered Evan Corcoran, Trump’s attorney, to provide normally privileged documents and testimony regarding Trump.

Freepers please correct me if I’m wrong about this, but IIRC the judge summarily declared Rudy was guilty, not based on introduced evidence, but because the judge claimed Rudy had failed to produce evidence the other side had requested. BUT the alleged evidence that caused the judge to award the election workers a default judgement, was not in Rudy’s possession. The government had withheld it from Rudy. So Rudy was deemed guilty on false grounds against which the government wouldn’t let him defend himself. All the jury is being allowed to decide is how much Rudy must pay, without him ever having had a chance to defend himself as to whether he was guilty of anything. If so, I’d hope this could be overturned on appeal, if any honest judges remain.
