Just when you thought 2024 couldn't possibly get any weirder — yes, I know it's still only January — a secret Barack Obama memo could prove the undoing of special counsel Jack Smith's case against Donald Trump.
America First Legal — whose suit against the DHS's Cybersecurity and Infrastructure Security Agency "unearthed new docs showing that the deep state knew the risks of mass mail voting in 2020 but censored these criticisms as 'disinformation'" — has another bombshell today.
"A secret Obama memo, the Presidential Information Technology Committee (PITC), regarding control of Presidential records could change everything in the DOJ’s politicized prosecution of Trump," the organization announced Tuesday on Twitter/X.
By executive fiat, Obama created the PITC following a 2014 Russian hack of the president's Executive Office computer network. The committee "includes representatives of the Departments of Defense and DHS, among others" and "established the President’s exclusive control over information resources and systems provided to the President," according to America First Legal.

Because the memo relied upon the Federal Records Act’s definition of “information system” as resources organized for the “use” and “disposition” of “information”, the memo gives the President exclusive control over information he receives.
This is relevant to what a President may reasonably believe about information given to him while in office.
Second, and related, if information stored on the PITC network formed the basis for Special Counsel Jack Smith’s prosecution of former President Trump, that evidence should have been disclosed to the former President and may be relevant to his liability.
America First goes on to explain that "Obama’s PITC memo may have created a reasonable belief in President Trump that he, in fact, had such authority" to "possess or retain... classified documents."

Going further, "if the records Trump allegedly destroyed are still preserved within the EOP or the U.S. Department of Defense as part of PITC-created information systems, then other claims in the indictment may be baseless."
Quote from Newsweek article: "Trump says important information relating to the case has not been turned over to him and his lawyers, but the government has argued that the information being "requested" is not relevant to the case."
Perhaps that Obama memo is part of the information Smith is hiding from Trump's lawyers.

stood for. It just confirms for us who incompetent they
are. Muxk renamed it, so they have to make a big deal out
of it.
The public can grasp these issues better than the

are. Musk renamed it, so they have to make a big deal out

The public can grasp these issues better than the

All government information, all Library of Congress, all patients and all historical data, all the knowledge of mankind are backed up. All the banking information is backed up as well as all the information from the courthouses digitized all over the nation.
The mandate in the mid-90s funded and put into place in 2001/2002 four US Army, 3 Air Force, 3 Navy, and 3 State Department/CIA, the NSA and all other agencies into physically hardended, multi-backups off-sites, complete with the dreaded Flash/Electronics safe mest for EMG protection.
The USG has some many redudant individual systems, so many other storage sites for the data, and the historical incremental changes, that they can go back to every transaction beginning in late 1990s.
Obama is so screwed. Biden is so screwed.
No one can hide or have deleted the information - it is permanently archieved and even if National Security is involved that TS information is further saved separately even if deleted from the database as corrections in order to determine if the correct decisions were made prior.
NSA could sink every single congress/senate or government employee using insider trading with a simpe query into the data base based on informational briefings and meetings and those people involved and their acquaintances.
Too bad NSA is not RIGHT or RIGHTWING or even above Politics, because they can clean up the entire nation overnight with the government implementaion of the clean ups.
The original document will be sent to the defendant’s attorney’s office via the nearest shredder.

Of course, they knew the risks (for Republicans) of mass mail voting and took advantage of them. Is there anyone who didn’t see that coming?
