"BORKING" OF PICKERING UNCONSCIONABLE

WASHINGTON, D.C. - Gary L. Bauer, Chairman of the Campaign for Working Families, called for Senate Democrats to stop their hijacking of the nomination of Federal District Judge Charles Pickering. "The 'Borking' of Judge Pickering is simply unconscionable," Bauer said.

The former presidential candidate made the following statement: "Senate Democrats are so desperate to protect the liberal stranglehold over the federal judiciary that they are willing to slander an honorable man. But don't take my word for it. Even the Washington Post, not exactly know for its conservative views, said in its own editorial, '…the attack on Judge Pickering has become an ugly affair.' The Post went on to call the racial accusations against Judge Pickering, 'particularly unfair,' and ended by saying that the character assassination of Judge Pickering by Senate Democrats was '…the latest example of the degradation of the confirmation process.'

"The fact is Judge Pickering is supported by many African-American civil rights leaders in Mississippi - the people who know him best. Supporters of his confirmation include Charles Evers, brother of slain civil rights leader Medgar Evers, Michael Moore, the Democratic Attorney General of Mississippi, and Democrat Frank Hunger, Al Gore's brother-in-law.

"To slander a man as 'racially insensitive' who in Mississippi in the 1960s, testified against a leader of the KKK, who sent his children to public schools during the height of the desegregation battles, and who has worked to increase investment in the African-American community, is preposterous.

"Furthermore, Judge Pickering was unanimously confirmed to his current federal court position in 1990. Four senators currently on the Judiciary Committee, Senators Leahy, Kennedy, Biden, and Kohl, voiced no concerns about Judge Pickering in 1990. Their current hypocrisy in opposing Judge Pickering is nothing more than the callous political calculations of petty partisans at its worst.

"If we allow these disgusting tactics to prevail, Judge Pickering's accusers will be emboldened and future nominees will be viciously slandered and unfairly savaged. We must not allow the 'politics of personal destruction' to hijack the confirmation process. I urge Senate Republicans to force a floor vote using every procedural method at their disposal."

That the Democrats would filibuster or slander a judicial nominee is hardly surprising. Of course it is reprehensible. It is just a light warmup to the first Supreme Court nomination.

The question we must ask is: what is President Bush prepared to do to get Pickering confirmed? How far politically is he willing to go?

Well, if Lott is the one sponsoring the judge, we have to assume Pickering is a rabid racist also, right??? The self righteous republicans here on FR should make their voices heard once again, join in with their democratic brethern.

Did you miss this one?

Republicans should frame their response to Democratic filibusters as a question of freedom. The issue is whether the people should be able to run their own country through the officials they elect.

America’s founders fought a revolution over this principle. Without the rule of law, we have no freedom. Leftists will not be able to defend letting judges rather than voters run the country.

Second, Bush should re-submit the nominations left unapproved during the 107th Congress. That includes the appeals court nominations of Charles Pickering and Priscilla Owen, who were rejected by Patrick Leahy’s Democrat-controlled Judiciary Committee. The Senate should quickly process and confirm these re-submitted nominees.

Third, Republicans should begin warning Americans of the tactics, including filibusters, to come. Public exposure may cause some Democrats to think twice.

Finally, Republicans must work more closely with activists. In an ideal world, appointing judges would not require massive grassroots campaigns, but it does today because judges have become too powerful and leftists want to capture the courts to short-circuit democracy.

Liberty depends on seizing this opportunity.

W. can do nothing about it because of separation of powers. The Senate may set its own rules and can vote to end the filibuster. What W. can do is make them wish they had not filibustered the nominee by punishing those senators politically. He can refuse to authorize the release of money for budgeted projects in their state.

You don't actually believe Lott was jettisonned because he's a "rabid racist" do you? I don't know if he's a racist, and frankly I don't care. He was dumped because he did more than a Dem in disguise would have done in his position to destroy the Republican party.

In theory, Schumer could kill the nomination.

In fact, he won't. All this is is an announcement to try to scare off Bush.

See, what happens these days is not Hubert Humphrey reading out of the telephone book. Rather, some senator announces a filibuster, so the opposition has to go around and collect sixty votes to force cloture.

The reason? In modern times, in the age of Cable TV, Schumer would have to get up and do a marathon speech against Pickering, or maybe a tag-team with Edwards and Leahy. This kind of circus would allow Bush to start ramming legislation through the House. While the filibuster was going on, Bush will be able to speak of the "sad vendetta" that Schumer and the "Hillary Clinton" Democrats have against this fine gentleman from Mississippi.

Bush will be able to bring legislation to the Senate and blame Schumer and company for obstructionism in time of war.

Then you'll start hearing stuff about Rove talking with Giuliani about 2004.

Bush and Frist will call his bluff. I promise you. Bush made the announcement about Pickering knowing that Schumer or Leahy (not Edwards; Slick Jr. doesn't want his hair to get mussed...)would scream filibuster. Watch.

I agree, prepare the people so they will be ready rather then falling into the democrats trap the way it happened in the Lott situation.
